(S. & H. Code § 8330 et. Seq.)
SUBJECT: ADOPT Resolution No. 2003/250approving the Termination of an Offer of
Dedication of an excess dedication for State Route 4 at'Bixler Road,
superseded by a deed to the State.

The Board of Supervisors of Contra Costa County RESOLVES THAT:
This Termination of an Offer of Dedication of an excess dedication for State Route 4
at Bixler Road not required for County street and highway purposes is made pursuant to
Government Code Section 66477.2(c) and to Division 9, Part 3, Chapter 4 of the Streets
and Highways Code, commencing with Section 8330, et. seq. A description and map of
the offered area to be terminated Is attached hereto as Exhibits "A" and "B" and
Incorporated herein by reference located In the Byron area.

copy of an action taken and entered on the
minutes of the Board of supervisors on the
date shown.

Subject: Terminate an Offer of Dedication of an excess portion of State Route 4 at
Bixler Road in the Byron area.
Date: April 15, 2003

Contra Costa County completed an Environmental Impact Report (EIR) for
Subdivision 845£ in 1992 (SCH #900030515). This document covers the road
improvements and adequately addresses the termination of excess right-of-way.
This termination of an offer of dedication is for an excess dedication of a street or
highway not required for County street or highway purposes. The offered area has been
superseded by a grant deed to the State. The State is the proper authority to accept and
maintain the right of way.
Considering all facts before it, this Board FINDS there is no reasonable probability
that the County will accept the offered roadway into the County road system and that no
public money has been expended for maintenance of the offered roadway.
This Board hereby TERMINATES the hereinabove described offer of dedication and
ABANDONS the right of the County to accept said offer. The Board is not aware of any
existing in place utilities in the subject area.
The Real Property Division is ORDERED to record a certified copy of this Resolution
in the office of the County Recorder.
From and after the date this resolution is recorded, the offer of dedication is
terminated and the County's right to accept offer is abandoned.

further described as follows:
