SUBJECT: ADOPT Resolution No. 2003/149 to summarily vacate an excess portion of
Erskine Street and determine that the activity is not subject to the California
Environmental Quality Act (CEQA) pursuant to Article 5, Section 15061
(b)(3), Port Costa area [CDD-CP##03-13].

The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer
required for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4
of the Streets and Highways Code,commencing with Section 8330, et. seq. A description
of the offered area to be vacated is attached in Exhibit "A" and attached hereto.
This vacation request is for an excess right of way for a street or highway not
required for street or highway purposes. (S. & H. Code Section 8334).

Subject: Summarily vacate an excess portion of Erskine Street in the Port Costa area.

This Board hereby FINDS that the proposed vacation will not have a significant
effect on the environment, and that it has been determined to be exempt from the
California Environmental Quality Act Under State CEQA Guidelines Section 15061 (b)(3)
and DIRECTS the Director of Community Development to file a Notice of Exemption with
the County Clerk, and DIRECTS the Public Works Director to arrange for payment of the
$25.00 handling fee to the County Clerk for filing and a $25.00 fee to Community
Development for processing of the Notice of Exemption. This Board having considered the
general plan FINDS pursuant to Government Code Section 65402 that in accordance with
its Resolution No. 811522, this vacation is minor in nature and is therefore exempt from
general plan conformance review.
This Board declares that the hereinabove described proposed vacation is HEREBY
ORDERED VACATED subject to any reservation and exception described in Exhibit "A"
and shown on Exhibit "B" attached hereto. From and after the date of this Resolution is
recorded, the portion vacated no longer constitutes a public highway.
The Real Property Division is ORDERED to record a certified copy of this Resolution
in the office of the County Recorder.

California, being a portion of Rancho Canada Del Hambre, also being a portion
of Erskine Street as shown on the "Map Of The Town Of Port Costa" filed
December 1, 1883, Contra Costa County Records and shown on the "Amended
Map Of The Town Of Port Costa" filed 1922 in file D565, County Public Works
Department Records, described as follows:
PARCEL 1 (Vacation,)
Beginning at the southeast corner of Lot 14, Block 4-1/2 as shown on said
Amended Map (D565); thence northeasterly along the southerly boundary line of
Erskine Street north 75'43'00" east, 67.69 feet to the southerly corner of Lot 6,
Block 2-112 as shown on said Map (D565); thence northwesterly along the
easterly Boundary line of Erskine Street north 41052'00" west, 12.50 feet; thence
leaving said line south 65"34'12"west, 62.89 feet to the Point of Beginning.
Containing an area of 375 square feet of lend (0.00861 acres), more or less.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the
Streets and Highways Code, the easement and right at any time, or from time to
time, to construct, enlarge, maintain, operate, replace, remove, and renew those
existing and in place utilities, as of the date of recording this instrument, in, upon,
over and across any highway or part thereof proposed to be vacated, including
access to protect the property from all hazards in, upon, and over the area herein
before described to be vacated.

(approximately 375 square feet)along the south end of Erskine Steet along the northeast portion of
APN 368-148-014. The County has determined that this portion of the offer of dedication is no
longer needed and can be terminated. (Fig. 4)
LOCATION:
The activity is located on Erskine Street in unincorporated west Contra Costa County in the Town of
Port Costa (Figures 1 —4).
