SUBJECT: ADOPT Resolution No.20031123 approving Exchange of Surplus Real Property
located at Martin Way, Pittsburg.

The Board of Supervisors of Contra Costa County RESOLVES THAT:
Contra Costa County acquired certain real property on November 16,2001 in the City of
Pittsburg, for highway purposes. A portion of said property, described in Exhibit"A" attached
hereto, is DETERMINED to be surplus and no longer necessary for County or other public
purposes.The parcel was purchased with Contra Costa Transportation Authority(CCTA)funds.
This Board hereby APPROVES and AUTHORIZES the exchange of said property to
Bishop-Wisecarver Corporation, pursuant to Streets & Highways Code Section 960 and the
Board Chair is hereby AUTHORIZED to execute a Grant Deed as partial compensation. The
estimated fair market value of the property is$631,000.The remaining balance of$2,680,000
shall be paid in cash by the County and reimbursed by Contra Costa Transportation Authority
as agreed upon in the Right of Way Contract.The County is acquiring approximately 1.43 acres
of land and improvements for the State Route 4 East Project on behalf of the Contra Costa
Transportation Agency.
The Real Property Division is DIRECTED to cause said Grant Deed to be delivered to
the grantee.
The Board of Supervisors ADOPTED the Mitigated Negative Declaration/Finding of No
Significant Impact on March 27, 2001. These property rights are required for the construction
of an expanded freeway along the southern portion of State Route 4 in the City of Pittsburg in
accordance with approved plans and specifications.

Land Description of a parcel of land, situate in the City of Pittsburg, Contra Costa County, California, and
being a portion of that certain property described in the Grant Deed to Stephen C. Henderson, Trustee of the
Stephen C. Henderson Family recorded on October 5, 1999 as Document No. 1999-0263974-00 in the Official
.Records of said County; Same parcel being a portion of Parcel "A", all of Parcel "B"and all of Martin Way as
created by that certain Parcel Map MS 678-92, filed November 3, 1992,in Book 160 of Parcel Maps, Page 9 of
the Map Records of said County, Also being a portion of the remainder of Parcel "A" as created by that certain
Parcel Map, filed September 2, 1970 in Book 14 of Parcel Maps at Page 9 on file in the Official Records of said
County; and being more particularly described as follows:
Beginning at the southwest corner of said Martin Way of said Parcel Map MS 678-92, same southwest corner of
said Parcel "A"of Parcel Map(14-PM-9); Thence along the west line of Martin Way and both aforementioned
Parcel "A"s",North 17°42" 45"East, 90.165 meters to the point of intersection with the curving south night of
Way line of State Highway Route 4, being a curve to the left from which the center bears North 171 07" 05"
East; Thence with the south line of State highway Route 4 in a easterly direction 193.342 meters along the arc
of said curve to the left, having a radius of 6044.896 meters and through a central angle of 01° 49" 57" to the
curving east line of said Parcel "A" of(14-PM-9), being a curve to the left from which the center bears South
