SUBJECT: ADOPT Resolution No. 2003/ 97 approving Notice of Intention to
purchase real property for County Affordable Housing Program
1872 Little John Way, Brentwood, California

The Board of Supervisors of Contra Costa County RESOLVES THAT:
It intends to purchase from Martin and Maria G. Santoyo, as part of the County's
Affordable Housing Program, certain real property described in Exhibit"A"attached hereto,
for $163,180.00, in accordance with the terms and conditions of the "Buyer's Purchase
Agreement for Affordable Units, Marsh Creek Vista Development," recorded March 24,
1995, by Instrument Number 95-046535, at the Office of the County Recorder.
This Board will meet on March 4, 2003, at 9:30 a.m. in the Board's Chambers,
County Administration Building, Martinez, California,to consummate this purchase and the
Clerk of this Board is DIRECTED to publish the attached notice in the Contra Costa Times
pursuant to Government Code Section 6063.

The land referred to in this Report is situated in the County of Contra Costa, City of Brentwood,
State of California,and Is described as follows:
Lot 25, Tract 7210 filed September 16, 1992, in Map Book 363, Page 40, Contra
Costa County Records.
EXCEPTING THEREFROM:
1. The minerals and mineral rights reserved in the deed to Ralph Martin, et ux,
recorded February 26, 1965, Book 4812, Official Records, Page 717, as follows:
"An undivided one-half (1/2) interest in and to all minerals, oil, or other
hydrocarbons, gas and all associated substances existing in or on said real
property, together with the right to explore, drill for, extract, take from,
remove and dispose of one-half (1/2) of any or all said minerals, oil, other
hydrocarbons, gas and all associated substances from said real property below a
depth of five hundred (500) feet from the surface thereof, by wells, equipment
and means located on the surface of adjacent land and extended into said real
property herein conveyed and hereinabove described at a point or points below a
depth of five hundred (500) feet from the surface of said real property."
2. The minerals and mineral rights as reserved by Ralph Martin, et ux in the
deed recorded November 16, 1988, Book 14717, Official Records, Page 15, as
follows:
All remaining oil, gas, casinghead gas, asphaltum and other hydrocarbons and all
chemical gas now or hereafter found, situated or located in all or any portion
of the lands described herein lying more than 500 hundred (500) feet below the
surface thereof, together with the right to slant drill for and remove all, oil,
gas, casinghead gas, asphaltum and other hydrocarbons and chemical gas lying
below a depth of more than five hundred (500) feet below the surface thereof,
but without any right whatsoever, to enter upon the surface of said lands or
upon any, portion thereof within five hundred (500) feet vertical distance below
the surface thereof.

NOTICE OF INTENTION TO PURCHASE REAL PROPERTY
The Board of Supervisors of Contra Costa County declares its intention to consider
the purchase from Martin and Maria G. Santoyo,at a price not to exceed$163,180.00,the
real property located at 1872 Little John Way, Brentwood, California, (APN 016-020-030),
more particularly described in Resolution No. 2003/ 97 of the Board, and will meet at
9:30 a.m., on March 4, 2003, in its Chambers, County Administration Building, 651 Pine
Street, Martinez, California, to consummate the purchase.
