Adopted this Order on January 21, 2003,by the following vote: AYES: WpmvJSMS GIOIA, unKm, =M, M DeSAU M NOES: NM ABSENT: N= ABSTAIN: NW Resolution No, SUBJECT: Resolution finding that adopted procedures were followed in the election of the project area committee for the Downtown El Sobrante redevelopment project; and directing the redevelopment agency to consult with the project area committee The Contra Costa County Board of Supervisors'RESOLVES THAT: On October 22, 2002,the Planning Commission of the County of Contra Costa selected the proposed project area boundaries and adopted the Preliminary Plan for the proposed :Downtown El Sobrante Redevelopment Project(the "Preliminary Plan");I and On November 5, 2002 the Redevelopment Agency of the County of Contra Costa(the "Agency") accepted the Preliminary Plan and h6 begun the preparation of the proposed Redevelopment Plan for the Downtown El Sobrante Redevelopment Project(the"Plan"); and The Board of Supervisors adopted Resblution No, 20021715 on November 12, 2002 in which the Council called for the formation of a Project Area Committee("PAC") and adopted procedures for formation of a Project Area Committee("Procedures for Formation of Project Area Committee and Procedures for Election of Members thereof for the Downtown El Sobrante Redevelopment Project") for the proposed Downtown El Sobrante Project Area(the "Project Area"); and On December 2, 2002, duly noticed public meeting was conducted for the purpose of providing information to the community about the proposed Plan and to explain the establishment of, functions of, and opportunity to serve on the PAC; and On January 9,2003, a duly noticed election was held for PAC membership; and At said election meeting, eight(8)members of the PAC were duly elected to represent Project Area business property owners,business operators,residential owner occupants, and residential tenants;and The Chamber of Commerce,an existing community organization, appointed to the PAC by the Board of Supervisors,has elected its one(1)representative to the PAC; and The Procedures provide that the existence of any vacancies on the PAC shall not prevent the PAC from carrying out its duties as required by law, and that those vacant positions may be filled by the PAC; and The Procedures provide the opportunity to file with the Board of Supervisors written challenges to the election or electoral process, stating the facts of the situation and the reasons why it is being challenged,no more that 15 days following the election; and No written challenges to the election or the electoral process for the PAC were filed with the Board of Supervisors or otherwise received by the Agency or staff. The Board of Supervisors hereby approves, as representative of the Project Area,the membership of the PAC for the proposed Downtown El Sobrante Redevelopment Project comprised of those persons on the list of PAC members attached hereto, labeled Exhibit"A" and incorporated hereby by reference. The Agency and its staff are directed to consult with and obtain the advise of the PAC with respect to the proposed Plan and related matters in the manner specified in the California Community Redevelopment Law. On November 5,2002 the Board of Supervisors sifting as the Governing Board of the Redevelopment Agency accepted the Preliminary Plan and authorized that a redevelopment plan adoption process be conducted. Because the proposed redevelopment plan could provide the Redevelopment Agency with the power of eminent domain for redevelopment activities, and that displacement of low and moderate income households could, as a result, occur, the Redevelopment Agency is required to establish a Project Area Committee (PAC). On November 12, 2002 the Board of Supervisors adopted Resolution 2002/715 which called for formation of a PAC and set forth procedures for its formation. The procedures governing formation of the PAC provided for eight of the nine seats on the PAC to be elected by the community on January 9, 2003. An election was conducted pursuant to the procedures established, and the slate of candidates set forth on Exhibit A were elected. The election process left one vacancy on the PAC — a second residential tenant representative. Pursuant to the Procedures adopted by the Board on November 12, 2002, the newly elected PAC will proceed to fill the position by appointment.
