Subject: Authorization for Contra Costa Environmental Health/General Programs to
submit a grant application to the California Integrated Waste Management
Board for a Waste Tire Enforcement Grant
Specific Request(s)or Recommendation(s) and Background and Justification
Request: .Approval of the following resolution,which authorizes Contra Costa Environmental
Health/general Programs to submit an application to the California Integrated Waste Management
Board for a Waste Tire Enforcement grant.
WHEREAS, hands are allocated and available from the California Integrated Waste Management
Board for grants to solid waste Local Enforcement Agencies (LEA) and cities and counties with
regulatory authority within the city and county government to perform enforcement/compliance and
surveillance activities at waste tire facilities,and,
WHEREAS,the California Integrated Waste Management Board has been delegated;the.responsibility
for the administration of the program within the state,setting up necessary procedures governing
application by cities and counties under the program; and,
WHEREAS,the applicant demonstrates it has sufficient staff resources,technical expertise, and/or
experience with similar:projects to carry out the proposed program:and,
WHEREAS,the applicant will enter.into an agreement with the State of California for implementation
of a waste Lire enforcement program;
NOW,THEREFORE,be it resolved that the Contra Costa County Board of Supervisors: Authorizes
the submittal of an application to the California Integrated Waste Management Board for a Waste Tire
Enforcement Grant for a period of up to five (5)years.
BE IT FURTHER RESOLVED that the.Director of Environmental Health,or their designee,is
hereby authorized and empowered to execute in the name of Contra Costa Environmental Health-
General Programs/LEA all necessary applications, contracts,payment requests, agreements,and
amendments hereto for the purposes of securing grant funds and to implement and carry out the
purposes specified in the application.

BackLyround:
Senate Bill(SB) 876 (Escutia,Statutes of 2000),Chapter 838) requires the California Integrated Waste
Management Board(CIWMB) to consider designating a city or county,or city and county as the
enforcement authority of regulations relating to the storage and handling of waste and used tires. It
also requires that if the Board designates a local entity for this purpose,it provides sufficient, stable,
and noncompetitive funding as provided in the Five-Year Plan for the Taste Tire Recycling
Management Program (Five-Year Plan). A$1.00 fee on neer tires sold in California provides funding
for California's Waste Tire Enforcement Grant program. With the Five-Year Plan,Contra Costa
Environmental Health,as a participating agency,will be ensured of a stable source of funding without
the need for an annual application. See attached for additional background information.
Contra Costa Environmental Health(CCEH)/General Programs is certified by the CRUMB as the
Local Enforcement Agency(LEA) for solid waste in Contra Costa County. The LEA staff provide
regulatory oversight for solid waste facilities,including permitting and inspection of landfills and
transfer stations. Other services provided include solid waste complaint investigations and code
enforcement. If the requested funds are granted, the LEA will investigate illegal tire disposal activities,
perform waste tine facilities inspections,and survey tire dealers,auto dismantlers, Lite haulers,and
other points of waste tire generation to ensure compliance with all applicable laws and regulations,
including a new required manifest system.
W.1�ETE TIRE PROGRAM
Instars, The LEA will develop and implement an effective inspection and compliance program
that includes providing guidance to facility operators and,when necessary, taking enforcement actions
to remediate threats to public health and safety,and the environment. Inspections will be conducted
of facilities that accept or store more than 500 waste tires at one location.
Si e I ve tQW. Businesses that generate waste tires will be inspected to ensure compliance with the
required manifest systema. Generators are required to use tire haulers that are registered through the
State of California. Waste tire transportation and final disposal are documented through the Lire
manifest system. The LEA will conduct site visits which will provide an opportunity to educate
businesses regarding regulatory requirements. This will also serve to establish a database of waste tine
generators within Contra Costa County and for CIWMB's main database,
Enforcement. Per direction of the CIV,714B, the following enforcement procedures will be followed
by the LFA if non-compliance is determined: 1) Issuance of Letter of Violation(LOV) and
requirement of a Corrective Action Flan (CAP) from the operator,2) Issuance of a warning letter if
the owner/operator fails to submit CAP,and 3) Enforcement measures will be taken in coordination
with CIWMB enforcement personnel and with advisement from CCEH and CIWMB Counsel.
SunLc_ann:ce. A surveillance campaign will be initiated to locate and mitigate illegal Lire disposal. It is
illegal to store or stockpile tires without required permits. Additionally,those transporting tires must
be registered by the State of California and must follow specific manifest requirements.
rai rig. Initially,training will be provided to the LEA by CIV,'MB personnel, As the term of the
grant contract progresses, the LEA will provide training and educational materials to the generators,
haulers,disposal site operators,and the community.
R- porfW , The grantee (or LEA)will be required to submit inspection reports on a quarterly basis.
The grantee will also be required to submit an annual report to the CPVMB summarizing the work
performed and accomplishments of the program at the end of the grant terra.
Pa exits. Grant funds are paid on a reimbursement basis for the actual costs directly related to the
implementation of the program.

If a Waste Tire Enforcement Program is implemented within Contra Costa County, the LEA will be
responsible for the oversight of approximately 500 waste tire generators,haulers,and disposal sites.
The LEA willl be authorized to request up to$300,000 annually in grant funds each year for up to five
(5)years, Contra Costa Environmental Health-General Programs/LEA will submit a',request in an
amount ranging from$225,000-$250,0100 for the fiscal year 2002-2003. Funding requests for
subsequent years will vary based on the scope of the program and the amounts available through the
CM`MB each year. The CIWM'B's current limit of$300,000 may increase during the:five (5)year term
as additional waste tire funds become available, The funding will,cover the cost of staff resources for
inspections,enforcement,and surveillance,equipment,a vehicle,and educational outreach for the
