HomeMy WebLinkAboutRESOLUTIONS - 01012002 - 2002-719 THE BOARD OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA Adopted this Order of November 5,2002,by the following vote: AYES: Supervisors Uilkema,Gerber,DeSaulnier,Glover and Gioia NOES: None ABSENT: None ABSTAIN: None RESOLU71ON NO.20021719 SUBJECT: IN THE MATTER OF AMENDMENTS TO THE PLEASANT HILL BART STATION AREA SPECIFIC PLAN The Board of Supervisors of Contra Costa County RESOLVES that: WHEREAS, there is filed with this Board and its clerk a copy of Resolution No. 33-2002, adopted by the County Planning Commission,which discusses proposed amendments to the Specific Plan for the Pleasant Hill BART Station Area(#SP2002-02). The resolution makes reference to the proposed amendments related to building setbacks for Sub areas 11 and 12 and the elimination of the Treat Blvd. pedestrian overcrossing at Oak Road. WHEREAS, on November 5, 2002,the Board held a hearing on said Specific Plan Amendments discussed by the Planning Commission Resolution 33-2002. Notice of said hearing was duly given in the manner required by law. The Board, at the hearings called for testimony of all persons interested in this matter. After taking testimony,the Board closed the public hearing. WHEREAS, the Board finds that the proposed Amendment to the Specific Plan will not have a significant impact on the environment. An Environmental.Initial Study,Mitigated Negative Declaration, and Mitigation Monitoring Program was prepared and adopted by the Board, after having considered all comments received thereon, for the Pleasant Hill Bart Station Area Specific Plan Amendments. These actions satisfy the requirements of the California Environmental Quality Act and County CEQA Guidelines. WHEREAS, the Board members having fully considered these Specific Plan Amendments discussed in Resolution No. 33-2002, the recommendations included in the County Community Development Department staff report dated November 5, 2002, hereby adopts the Amendment to the Specific Plan related to the reduction of building setbacks for Sub areas i I and 12. The Board deferred consideration of the Amendment to the Specific Plan related to the elimination of the Treat Blvd. overcrossing at Oak Road until such time that a Final Development Plan is considered for the BART property. The Board further resolved that although the developer of the BART property would be required to participate in the financing of the bridge,no money should be collected from the developer to pay for the bridge until a final decision related to the bridge is made. WHEREAS, the Board made the following findings pursuant to the Contra Costa County General Plan Growth Management Element and County Code Sections 84-66.1406. 1 L Growth Manaem g Element Findings a) Ti, c: Traffic impacts have been addressed in the DEIR for the Pleasant Hill BART Station Specific Play. A comparison of the proposed project's trip generation characteristics with the alternatives evaluated in the 1998 EIR shows that the traffic generated by the project is within the lower and upper range of impacts and mitigation measures identified in the 1998 EIR. b) r: Contra Costa Water District indicated they have capacity to serve the project. c) Sanityewer: The project is within the boundaries of the Contra Costa Central Sanitary District,service is planned for the area. d) Fire Protection: The subject property is within. the Contra Costa Fire Protection District Boundaries and the project is required to comply with all of the District's requirements, including the payment of fees. c) Public P fin:Although no comments were received from the Sheriffs Department on the Preliminary Development Plan, staff expects comments from the Sheriff's department when the plans are more detailed when the Final Development Plan(s)are submitted. f) Parks Pad Recreation: Park dedication fees are required per County Ordinance for residential projects. The fee is used to provide parks/recreational opportunities within the area and would offset any impacts to parks. g) Flood Control and Drainage: The project will be required to meet all collect and convey requirements.
