SUBJECT: Accept Exoneration of Deferred Road Fee Agreement (to mitigate traffic impacts
along El Sobrante Transportation Corridors) for DP 3038-83, El Sobrante area.
(District I
On October 21, 1986,the Board authorized the Public Works Director to execute a Deferred
Road Fee Agreement with Janice E. Triplett, Mariel D. Nyman, Paul H. Triplett, Wilhelmenia
Triplett and Howard S.Nyman for a$26,000 road fee to mitigate traffic impacts along transportation
corridors in the El Sobrante area as required by the conditions of approval for DP 3038-83.
The aforesaid Deferred Road Fee Agreement was recorded on October 27, 1986 in Volume
13217 of Official Records at page 145 and became an encumbrance against Assessor's Parcel No.
420-140-033 and 420-140-034,now 420-140-039.
The Public Works Director now informs this Board that the requirements outlined in said
agreement have been satisfied. The required road fee was deposited by Triplett&Associates on July
10, 1987.
The Board hereby FINDS that the conditions of the above-mentioned Deferred Road Fee
Agreement are satisfied.
NOW THEREFORE BE IT RESOLVED that the aforesaid Deferred Road Fee Agreement is
EXONERATED.

Z. PURPOSE. Owner desires to develop the property he owns as described in
}+ xxhiSit "A" attached hereto and wishes to defer payment of a road fee as
stated in the conditions of approval, and County agrees to such deferment if
` Owner promises to pay the fee as herein provided.
'. 3. AGREEMENT BINDING ON SUCCESSORS IN INTEREST. This agreement is an

in Exhibit "A". All the terms, covenants and conditions herein imposed are
for the benefit of County and the real property or interest therein which
Vi constitutes the County road systems and shall be binding upon and inure to
the benefit of the land described in Exhibit "A" and the successors in
�. interest of Owner. Upon sale or di�.,sion of the property described in
* Exhibit "A", the terms of this agreement shall apply separately W each
parcel, and the owner of each parcel shall succeed to the obligations r
im seed••on Owner by this a r�arrant. Upon annexation to any city, Owner, or

4. ROAD FEE.

paid when required in the manner set forth in this agreement.

Dear Mr. Triplett:
The Conditions of Approval for DP 3038-83 and- LUP 2057-84 required a total
payment of $32,800 in road fees. We aflowed the deferral of the ! oad fees until
the County had adopted a road fee ordinance in the area, the El Sobrante Area of
Benefit. The El Sobrante Area of Benefit was adopted in June 1985, at which time
you were obligated to pay the fees at the issuance of the building permits.
0ur records indicate that the fees have not been paid, and that .b-Old-i-ng--permits __. ... ..__ ._
have been issued and some have been finaled. We have notified our Building
Inspection Department to hold up on ,any additional final inspections until the
fees are paid.

This is in reference to my memo of lune '8, '987, regarding :he road fees due for
LUP 2057-84 and OP 3038-83.

d The Conditions of Approval for LUP 2057-84 ;revised Aoril 30, 1984) state that
the developer shall pay the road fee required by the El Sobrante Area of Benefit,
not to exceed $26,000. The fee is $1.25 per square foot gross floor area for
7 commercial development and I understand the square footage is 17,376 square feet
(please verify) . Therefore, the road fees jue at this time total $21,720 instead
of 532,300 as stated in ny earlier ,memo.
