(District III) I. RECOMMENDATIONS) Pursuant to Government Code Section 61600, CONSENT to the Discovery Bay Community Services District(also known as the Town of Discovery Bay)providing flood protection services, consisting of the inspection and perpetual maintenance and operation of the levee system constructed by the developer of the Discovery Bay West Project. This consent is contingent on LAFCO's approval of the Discovery Bay Community Services District's exercise of the flood protection services. II. FINANCIAL IMPACT There is no anticipated impact to the General Fund. The Community Services District will assume all costs and expenses associated with the maintenance and operation of the levee system. BACKGROUND/REASONS FOR RECOMMENDATIONS The conditions of approval for the Discovery Bay West Project(Subdivision 8023) require the developer,Hofmann Land Development Co.,to construct a levee system, to provide a plan for perpetual maintenance of the system, and to identify a maintenance entity, such as a homeowners association, acceptable to the Public Works Department. Regulations of the Federal Emergency Management Agency ("FEMA") require that a governmental agency have ultimate responsibility for maintenance of'a levee system in flood hazard areas. The Discovery Bay Community Services District ("CSD") qualifies as a governmental agency to assume ultimate responsibility for perpetual maintenance of the Discovery Bay West levee system. In November 2000, the CSD obtained voter approval to exercise its latent powers to construct, maintain and operate flood protection works and facilities. In order to exercise these powers,the CSD must also obtain the consent of the County's Board of Supervisors pursuant to Government Code Section 61600(q)(2). The CSD has requested that the Board of Supervisors give such consent. The Public Works Department has reviewed that request and recommends that the Board give the requested consent. The CSD's maintenance ofthe levee system will not conflict with the authority of other public agencies, in that the levee system is not within the jurisdiction of Reclamation District No. 800 or the Contra Costa County Flood Control and Water Conservation District. NOW,THEREFORE,IT IS RESOLVED that upon LAFCO's approval,the DiscoveryBay Services District is APPROVED to provide flood protection services. RESOLUTION NO. 2002/395
