(District IV)Project No. WA 5489 Acting as conducting autho-ity under the Cortese-Knox Act Local Government Reorganization Act of 1985 (Government Code Section 56425 et. seq.), the Board of Supervisors of Contra Costa County (Board) FINDS, RESOLVES AND ORDERS THAT: 1. This action is being taken pursuant to the Cortese-Knox Act. 2. On March 26, 2002, the Board of Supervisors approved Resolution No. 2002/191, Resolution of Application requesting the Local Area Formation Commission (LAFCO) consider the formation of County Service Area (CSA)M-31,Pleasant Hill BART Station Area for Transportation Demand Management Services. 3. On April 23, 2002, the Board adopted Resolution No. 2002/256 approving the boundary reorganization for CSA M-31 Pleasant Hill BART Station Area and Resolution No. 2002/257 accepting the Engineer's Report and fixing June 11, 2002 at 1:30 p.m. for public meeting to consider establishing; a Sphere of Influence and Benefit Assessment for CSA M-31 Pleasant Hill BART Station Area. 4. Based on it's review of the Engineer's Report, this Board submits to LAFCO for consideration the following statement of its determinations: A. Present and Planned Land Uses in the Area The current land use in CSA M-31 is commercial office buildings, hotels and athletic facilities. The commercial property owners have a mandate to achieve 30% or more of the employees to arrive at work in something other than a single occupied car. The Transportation Demand Management(TDM)services program provides shuttle operations, a transit subsidy program, shuttle vehicle replacement, bike station/worksite bike parking/pathfinder program and vanpool operations. Present and Probable Need for the Public Service The TDM programs being funded by the assessment are the means by which the Pleasant Hill BART property owners fulfill one of the conditions of approval. The condition establishes a goal to achieve at least 30% of the employees in the area arrive at work through alternative means (transit, bike, walk) in a non-single occupied vehicle or through some other approved approach. C. Present Capacity for Provisions of Public Services The Contra Costa Centre Association is the collective mechanism by which the TDM program is undertaken. The Contra Costa Centre Association is a private non-profit corporation who's membership is the commercial property owners of the area. The Centre Association has been in existence since the mid 1980's. The original funding source for the TDM program has been exhausted. The formation of CSA M-31 and levy of assessments will enable the continuance of the TDM program. D. Social and Economic Communities of Interest Agency Providers The Contra Costa Centre Association is fulfilling Contra Costa County Ordinance No. 97-12 establishing the policies, purposes, goals and objectives for transportation system management with respect to promoting the use of vanpools,carpools, and park and ride lots. Now,therefore,the Board of Supervisors ORDERS AND RESOLVES THAT: 1. The Board accepts and approves the Statement of Determination.
