HomeMy WebLinkAboutRESOLUTIONS - 01012002 - 2002-358 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on (date), by the following. vote: AYES: WpMIS UILii %, ,.GEM, De�M, Com}m and GI01 NOES: ABSENT: NM ABSTAIN: NCS Resolutton No. 2002/358 Subject: Application to the Contra Costa } County Local Agency Formation Commission ) Requesting Consolidation of the Oakley Fire } Protection District, Bethel Island Fire Protection } District, and the East Diablo Fire Protection District) Into a single District and to dissolve the Bethel } Island, East Diablo, and Oakley Fire Protection } Districts. ) Govt Code Sections 56020, 56021, 56030, 56036, } 56700, 56701, 56475 ) WHEREAS, _ NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors of the County of Contra Costa, acting as the governing board of the Bethel Island, East Diablo, and Oakley Fire Protection Districts, hereby requests that the Local Agency Formation Commission of Contra Costa County concurrently consolidate the Oakley, Bethel Island, and East Diablo Fire Protection Districts into a single fire protection district called the "East Contra Costa Fire Protection District'" and to dissolve the Oakley, Bethel Island, and East Diablo Fire Protection Districts. 1. This proposal is made pursuant to the Cortese-Knox Act, Government Code section 56000 et seq. 2. The boundaries of the territory to be consolidated into a single District are set forth in Exhibit (maps of the area). The Board of Supervisors also requests that the sphere of influence(SOI) boundaries be amended to reflect the corrected boundaries. 3. The proposed reorganization is categorically exempt from CEQA. 4. The terms and conditions proposed for the consolidation are as follows: • The new District, "East Contra Costa Fire Protection District," shall be governed by the Contra Costa County Board of Supervisors. • The effective date of the consolidation and dissolution of the Oakley, Bethel Island, and East Diablo Fire Protection Districts shall be September 12, 2002. • All fund balances that have accumulated as a result of property taxes, or any other taxes, fees, or levies, collected by or on behalf of the Bethel Island, East Diablo, or Oakley Fire Protection Districts shall be transferred from their existing accounts to the new East Contra Costa Fire Protection District. Any benefit assessments or development fees associated with any existing fire district shall be restricted for use in the area of the consolidated district that corresponds to the territory of the former fire district in which the revenue source was implemented.The East Contra Costa Fire Protection District will deposit capital funds based on their origin and maintain separate funds for these capital reserves. • All equipment and all other personal property, all real property and all records, funding, rights, liabilities and assets, whether tangible or intangible, of the Oakley, Bethel Island, and East Diablo Fire Protection Districts shall be transferred to the new East County Fire Protection District • The East Contra Costa Fire Protection District will honor any employment agreements for personnel employed by the Bethel Island, East Diablo, or Oakley Fire Protection District, unless and until they are changed by agreement of the parties, or by lawful action by the respective fire protection districts individually so long as they exist or until otherwise modified through the meet-and-confer process. 5. The reason for this proposal is to allow more cost-effective application of existing resources to provide a higher level of fire protection and emergency medical response services in the Bethel Island, East Diablo, and Oakley Fire Protection District areas. The specific benefits of the consolidation are: • Shared managerial and administrative costs, increased backup response, greater advancement opportunities for personnel, reduced overtime costs, and coordinated disaster planning. • Potential improved paramedic service response in the Oakley Fire Protection District. • Development of a system for fire suppression and emergency medical services which matches the needs and constraints dictated by community design and local topography. 6.
