In the Matter of Declaring an } Emergency and Authorizing Disbursement } Of Funds Required To Repair Fire Damage } and Implement Security Measures at the McBrien } Administration Building, 651 Pine Street, Martinez ) RESOLUTION NO. 20021 318 THE CONTRA COSTA COUNTY BOARD OF SUPERVISORS (in its capacity as governing Board of the County of Contra Costa and all districts of which it is ex- officio governing Board) RESOLVES THAT: WHEREAS, on May 1, 2002, the County Human Resources Department experienced a fire that damaged file cabinets, fixtures, walls, and ceilings on the second floor, as well as caused smoke damage to both the second and third floors and damage to other floors as may later be determined; and WHEREAS, to permit continued operations and services, fire, smoke, and water damage must be controlled and damage must be repaired in the shortest possible time; and WHEREAS, security measures need to be implemented to help insure a safe working environment and to guard against future fire and other acts against County property; and WHEREAS, using the normal design and bid process, repairs could not begin for approximately three months; and Resolution No. 20021318 WHEREAS, pursuant to Sections 20134 and 22050 of the Public Contract Code, the normal procedures for bidding do not apply, and repairs can begin immediately when the appropriate findings of an emergency are made by the Board, and WHEREAS, it is recommended that the Board make such findings; direct the Director of General Services to proceed with the project and enter into any necessary contracts; and declare that, as an emergency, the project is not subject to the provisions of the California Environmental Quality Act (Public Resources Code Section 29080 and following); and WHEREAS, it is further recommended that the Board find, based upon substantial evidence before it, as set forth in the minutes of this meeting, that: (1) this emergency will not permit a delay resulting from a competitive solicitation for bids; and (2) this action is necessary to respond to the emergency. NOW, THEREFORE, BE IT RESOLVED that: (1) Pursuant to Public Contract Code Sections 20134 and 22050, FIND that an emergency exists, that the emergency will not permit a delay resulting from a competitive solicitation for bids, and that the action described in this Resolution is necessary to respond to the emergency; (2) DELEGATE to the General Services Director the authority to proceed in the most expeditious manner with the evaluation, assessment, and implementation of fire damage repair and restoration; (3) FURTHER DELEGATE to the County Administrator and Director of Human Resources and/or their designee(s) the authority to proceed in the most expeditious manner with the evaluation and assessment of security needs and the implementation of necessary security measures; (4) AUTHORIZE the Risk Manager, General Services Director, County Administrator, and County Auditor-Controller to disburse funds as required to implement fire damage repair and restoration and to evaluate, assess, and implement security measures; (5) DIRECT the General Services Director to make reports to the Board, as required by Public Contract Code Section 22050, stating the reasons justifying why the emergency will not permit a delay resulting from competitive solicitation for bids and why the action is necessary to respond to the emergency, in order to enable the Board to review the emergency action and to determine that there is a need to continue the action; and Resolution No. 2002/31€3 (6) DECLARE that the project, as an emergency, is exempt from the provisions of the California Environmental Quality Act under Public Resources Code Section 21080(b)(2) and (4) and Section 15269(b) and (c) of the State CEQA Guidelines.
