Weir, County Clerk-Recorder C&O By: Candy Lopez, Assistant County Registrar .. , DATE: May 1, 2002 " SUBJECT: In the Matter of Calling an Appropriations Limit Increase Election Within the County Service Area R-7A RE80ixJ CN No. 2002/296 SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: ADOPT this resolution calling for an appropriations limit increase election on November 5,2002 for County Service Area R-7A. BACKGROUND: When the Gann Initiative(Prop.4)became effective in 1979, it imposed a limit on the future expenditures of service areas. However,voter approved overrides allow for an increase in appropriation limits. County Service Area R-7A's override expires in 2001-2002. Based on historical information,without the current override,the district would exceed its 2001-2002 appropriation limit. An override for fiscal year 2002-03 may be required to cover any projected excess revenue from fiscal year 2002-03. Due to a clerical error the original measure was not on the March 5,2002 election. This resolution is being re-submitted so it may appear on the November 5, 2002 General Election. The Board of Supervisors of Contra Costa County as the Board of Directors of the County Service Area R-7A (CSA R-7A) RESOLVES THAT: 1. Date. Consolidation. Pursuant to Section 4 of Article XIII-B of the California Sate Constitution, an appropriations limit increase election is hereby called for CSA R-7A on November 5,2002 and it shall be consolidated with any other election(s) in CSA R-7 on that date. 2. Ballot Measure. This election shall be conducted by submitting to the voters of CSA R-7A ballot measure in substantially the following form: "Shall the appropriations limit under California Article XII-B for County Service Area R-7A be increased to$675,000 and adjusted for changes in the cost-of-living and population,with the increase effective for the fiscal years 2002/2003(inclusive)to provide for the expenditure of funds thatwill be available to the Service Area during the stated fiscal years?" 3. Notice. Conduct, The County Clerk(Elections)shall take all steps necessary to provide appropriate notice of the election and to conduct it in accordance with applicable provisions of the Elections Code (Section 5200 ff) 4. Not Mail-Ballot. The election shall not be by mail ballot.
