BACKGROUND/REASONS FOR THE RECOMMENDATION
At a continued public hearing conducted on Tuesday, June 25, 2002, the Board of Supervisors
concluded the public hearing testimony, closed the public hearing, and declared an intent to approve
the General Plan Amendment, Rezoning, and Related Entitlement Actions for the project which
includes Alamo Creek and Intervening Properties/Remaining intervening Properties,and continued the
matter to Tuesday, July 9,2002 for the purpose of further deliberations,the consideration of findings,
the receipt of a supplemental staff report concerning issues raised by Board members at the June 25
continued public hearing, and to take final actions.At the June 25,2002 continued public hearing,the
Board indicated the possibility of reopening the hearing for the limited purpose of taking further
evidence on the issues described above.
Attached to this report for the Board's consideration are three items:
• Attachment#1: Supplemental Staff Report responding to questions, comments, and concerns
raised by Board members at the continued public hearing on June 25, 2002.
• Attachment#2: Board Resolution No. 2002/262 approves the Camino Tassajara Combined
General Plan Amendment, Rezonings, and Related Entitlement Actions. The resolution
includes attached exhibits related to the required findings,the conditions of approval, and the
affordable housing program agreements, as follows:
Exhibit"A'", CEQA Findings;
Exhibit"B", CEQA Mitigation Monitoring Program;
Exhibit"C", Conditions of Approval for Alamo Creek and IP/RIP;
Exhibit"D", General Findings; and,
Exhibit "E", Camino Tassajara Affordable Housing Program agreements.

On this date the Board of Supervisors considered the Camino Tassajara Combined General Plan
Amendment Study and Related Actions (County File: General Plan Amendment#98-0004,#99-
0002 and#99-0003;Rezoning#99-3076,#99-3079 and#99-3080; Subdivisions#8331,#8381
and#8382; and Preliminary and Final Development Plans#99-3032 and#99-3042).
Dennis Barry,Director, Community Development Department and Patrick Roche, Community
Development Department presented the supplemental staff report responding to the questions,
comments and concerns raised by the Board of Supervisors at the continued public hearing on
June 25, 2002. In addition to the supplemental staff report,Mr. Barry advised the Board there
was a green"Errata Sheet",which contains corrections in the Exhibit`°A"of the Board of
Supervisors Resolution No. 2002/262,Findings Pursuant to the California Environmental
Quality Act("CEQA") and Exhibit"C"of the Conditions of Approval. Staff also received
signed copies of the Camino Tassajara Affordable Housing Program from the applicants and a
letter from Cecily Talbart, dated July 9,2002, on behalf of Shapell Industries and Ponderosa
Homes,withdrawing their appeal"of the Planning Commission.Resolution No. 18-2002,
provided that the Camino Tassajara Integrated Project is approved in accordance with County's
staff's recommendation in its staff report of July 9,2002". The letter also states that Braddock
and Logan "also withdraws its appeal on the same condition, except that it maintains its request
that staff's Condition No. I I be deleted so that the six lots at the southern end of D Street remain
in the IP/RIP projects for reasons set forth".
Supervisor Uilkema presented the revision to the proposed Condition of Approval 138B for
County File DP#99-3042 and Subdivisions 99-8381 and 99-8382 (Alamo Creek) and Condition
of Approval 118B for County File DP#99-3032 and Subdivision 99-8331 (Intervening
Properties/Remaining Intervening Properties). Condition of Approval 138B and 118B IP/RIP
concerns the public transit service for the Alamo Creek Development.
After discussion by members of the Board and staff,the Chair re-opened the public hearing. The
following persons requested to address the Board on this matter:

The Chair then returned the matter to the Board and after mer discussion between staff and
Board members,the Board of Supervisors took the following action:
♦ ACCEPTED a supplemental staff report responding to the questions,comments, and
concerns raised by the Board members at the continued public hearing on June 25,2002;
♦ CLOSED the public hearing;
♦ DEFIED the appeal of the Town of Danville on the County Planning Commission's action
on January 28,2002 relating to approval of Subdivision Maps for the Intervening/Remaining
Intervening Properties(Subdivision#99-8331)and Alamo Creek(Subdivision#99-8381/99-
8382);
t DENIED the appeal of Braddock&Logan,LLP relating to the County Planning
Commission's approval of Subdivision Map for the Intervening/Remaining Properties on
Condition of Approval No. I I that results in the loss of six lots at the Southern end of"D"
Street;
a ACCEPTED the withdrawal of appeals of Shapell Industries of Northern California and
Ponderosa Homes;
♦ ADOPTED Resolution No. 2002/262 approving the Camino Tassajara Combined General
Plan Amendment,Rezonings,and Related Entitlement Actions,including the certification of
the EIR(SCH#99-122013),adoption of CEQA Mitigation Monitoring Program,and the
approval of the Conditions of Approval for Intervening Properties/Remaining Intervening
Properties(Subdivision#99-8331 and Preliminary and Final Development Plan#99-3032)
and Alamo Creek(Subdivisions#99-8381/99-8382 and Preliminary and Final Development
Plans#99-3042),as amended today,and the findings therein;
♦ AUTHORU ED the Chair,Board of Supervisors to sign and execute the accompanying
Camino Tassajara Affordable Dousing Program Agreement;
a ADOPTED Ordinance No. 2002-20 giving effect to the aforementioned rezoning;
i DIRECTED the Community Development Department staff to file and post the Notice of
Determination.
The Board of Supervisors vote was as follows:
