HomeMy WebLinkAboutRESOLUTIONS - 01012002 - 2002-202 t2W In the Matter of Supporting SB 1736, Agricultural Employer-Employee Disputes: Binding Arbitration ) RESOLUTION NO.2002/202 WHEREAS,existing law provides that agricultural employees have the right to form and join labor unions and to bargain collectively through representatives of their own choosing;and WHEREAS, existing lawn provides that a refusal to bargain in good faith by an agricultural employer or by an employee labor organization constitutes an unfair labor practice;and WHEREAS, endless delaying tactics and lack of due diligence conducted by employers have hindered negotiations with anions,and WHEREAS, SB 1736 would authorize the submittal of a written petition by an agricultural employer or a labor organization to the Agricultural Labor Relations Board(ALRB)requesting that an arbitrator be assigned and a hearing be held where the parties can present to the arbitrator their respective collective bargaining positions and proposals,and WHEREAS,the arbitrator after reviewing the collective bargaining position and proposals of the parties would thea issue a remedy consisting of a collective bargaining agreement that the parties would be bound to,and WHEREAS,SB 1736 would set the parameters of the petitions and the ALRB would within 7 days of the filing of the petition make a determination if reasonable cause exists to submit the matter to binding arbitration and upon reasonable agreement,appoint a neutral arbitrator to hear the matter,and WHEREAS,SB 1735 would provide a process that can prevent labor disruption which is costly to consumers,labor and employers, THEREFORE,BE IT RESOLVED that the Contra Costa County Board of Supervisors supports SB 1736,an historic farm workers'rights bill.
