RESOLUTION NO. 2001/ 608

SUBJECT: ADOPT Resolution No. 2001/o08 to sell surplus County real property located at
648 2nd Street to the City of Brentwood, and determine that the activity is a Class
12 Categorical Exemption for CEQA compliance pursuant to Section 15206(b)(4).

The Board of Supervisors of Contra Costa County RESOLVES THAT:
Contra Costa County acquired certain real property on December 9, 1932 in Book 333 at
page 366, described in Exhibit "A" attached hereto, for County services. Said property is
DETERMINED to be surplus and no longer necessary for County purposes.
This Board hereby APPROVES and AUTHORIZES the sale of said property to the City of
Brentwood, pursuant to Government Code Section 25526.5 and the Board Chair is hereby
AUTHORIZED to execute a Grant Deed on behalf of the County in consideration for the
payment received in full in the amount of$5,000, in accordance with the terms and conditions of
the Real Property Sales Agreement, attached hereto as Exhibit "B".
The Real Property Division is DIRECTED to cause said Grant Deed to be delivered to the
grantee.
The Public Works Director is hereby AUTHORIZED to sign the Real Property Sales
Agreement on behalf of the County.
The Board hereby FINDS that the project will not have a significant effect on the
environment, and DETERMINES that the project is exempt from the requirements of the
California Environmental Quality Act as a Class 12 Categorical Exemption under County
Guidelines and Section 15312 of the State CEQA Guidelines, and DIRECTS the Director of
Community Development to file a Notice of Exemption with the County Clerk and DIRECTS the
Public Works Director to arrange for payment of the$25.00 handling fee to the County Clerk for
filing and a $25.00 fee to Community Development for processing of the Notice of Exemption.
This activity has been found to conform to the General Plan of the City of Brentwood.

REAL PROPERTY SALES AGREEMENT
THIS AGREEMENT is made and entered into this day of ,
by and between Contra Costa County, a political subdivision of the State of California,
hereinafter called "Grantor" and the City of Brentwood, a municipal corporation, hereinafter
called "Grantee."
In consideration of the covenants and conditions hereinafter contained, it is mutually
agreed as follows:
1. Grantor hereby agrees to sell and convey that certain real property described
in Exhibit"A", attached hereto and made a part hereof, to the Grantee forthe
sum of $5,000. If Grantee ceases to use the property for civic and public
purposes or the Grantee sells this property, the Grantee will pay the County
$80,000 dollars, which represents the fair market value of the property less
the $5,000 already received.
2. The Grantor will continue to have exclusive parking rights on this property to
support the Grantor's lease (amended lease between the City of Brentwood
and Contra Costa County dated June 20, 2000) of the Grantee's property
located at 118 Oak Street for the operation of the Brentwood Health Clinic.
The parking rights will continue during the term of this lease or extension
thereof at no additional costs.
3. The right, title and interest in the property to be sold shall not exceed that
vested in the Grantor, and said property is sold subject to all existing
easements, covenants, conditions, restrictions, reservations, and all other
encumbrances, whether the same be recorded or unrecorded.
4. Grantee shall pay all costs of escrow, title insurance, and recording fees, if
applicable.
5. Grantor shall retain possession of the property up to the date of recording the
deed.
6. The Grantee understands that this sale is subject to approval by the County
Board of Supervisors, and the Grantor reserves the right to cancel the sale at
anytime prior to the recording of the deed. In the event of cancellation of
sale, all monies deposited shall be refunded without payment of interest.
7. Upon approval of the sale by the County Board of Supervisors, Grantor will
cause to be delivered to Grantee a grant deed to the property properly
executed by the Grantor.
The parties herein have set forth the whole of their agreement and the performance of this
agreement shall relieve the grantor of all further obligations or claims on this account.

Project Description, Common Name (if any) and Location: 648 2nd Street, Brentwood-Sale Project,
County File CP# 00-103. Project Description: The project consists of the sale of 648 2nd Street(parcel
number 013-120-014)to the City of Brentwood (City) for the continued use of the Brentwood Women's Center
with two restrictions: 1) If the City ceases to use the property for civic and public purposes or sells the
property, the City will pay Contra Costa County (County) $80,000.00; 2) The County will retain parking rights
on parcel number 013-120-014.
Currently, the County leases the building at 648 2nd Street (APN 013-120-014) to the City of Brentwood for
the Brentwood Women's Center. In addition, the County leases 118 Oak Street (APN 013-120-018) from the
City for the operation of the Brentwood Health Clinic. Although the County does not use the building at 648
2nd Street, it does require the use of the small parking lot on the parcel (for parking for the patrons of the
Brentwood Health Clinic). Since the County does not use the building at 648 2' Street, the City will purchase
the parcel from the County for the continued use of the Brentwood Women's Center. The City has agreed
to allow the County to retain usage of the parking lot on the parcel for the Brentwood Health Clinic. Project
Location; The project is located in the east county area, at 648 2nd Street in the City of Brentwood (Figures
1 -3).

Community Development staff has reviewed the attached project, CP 00-LO-
J_ to determine if
mandatory referral for General Plan Conformance, as required by Section 65402 of the
Government Code, is necessary.
The project needs no further mandatoryreferral clearance from County staff subject to the
following actions:
( ) This project has been determined to be exempt from 65402 review.
( ) This project has been determined to be exempt from 65402 review in accordance
with the Board of Supervisors Resolution 81/522 because the project involves a
road alignment project of a minor nature.
