GRANT DEED OF DEVELOPMENT RIGHTS
(Delay of Private Road Construction)
To meet conditions of approval numbers 8A3), 8A4) and 813, of Subdivision 72-90, Olesen Living
Trust, dated March 19, 1979 FBO Orville and Betty E. Olesen and The Burton H. Duke and
Constance B.Duke Trust,dated January 31,1980(Residuary Trust B-1)(Owners)hereby grant to
the County of Contra Costa, a political subdivision of the State of California (Grantee) and
governmental successor or successors of said county,the future development rights,as defined herein
below, over all of that real property known as Parcels "A, B, C and D", of Subdivision MS 72-90,
situated in the County of Contra Costa, State of California and more particularly described in Exhibit
"A„
Development rights are defined to mean and refer to the right to approve or disapprove of any
proposed construction,development or improvement. The development rights are and shall be a form
of covenant, which shall run with the said property and shall bind the current Owner and any future
Owner of all or any portion of said property.In the event of a disapproval of proposed construction by
Grantee,or successor Grantee,said proposed construction shall not be performed.It is understood that
Grantee, or successor Grantee,will condition the approval of the first building permit for any of the
parcels described in Exhibit"A"upon the construction of a 20-foot wide road,with a turnaround at the
end, to County private road standards(per conditions of approval 8A3), 8A4) and 8B of Subdivision
MS 72-90)or assurance by Owner in the form of a subdivision agreement with related cash and surety
bonds guarantying said construction and in addition, prior or subsequent performance of such
conditions as Grantee,or successor Grantee,may deem appropriate. It is also understood that Grantee,
or successor Grantee,will quitclaim those development rights back to Owner or future Owner,when
the above mentioned road construction is completed or assured.
