WHEREAS, The Board of Supervisors believes it is in the public interest to ensure that loss of income for persons called to active military duty, during the current armed conflict, be minimized to the extent possible. Currently, in accordance with the California Military and Veterans Code, the County provides eligible employees with their full salary for the first thirty (30)days while on military leave of absence in any fiscal year for purposes of ordered, active duty. This action will augment existing provisions applicable to employees called to active duty as a result of Operation Enduring Freedom. NOW, THEREFORE, BE IT RESOLVED that, effective September 11, 2001, County employees who have been called to active military duty in direct connection with the current armed conflict, after exhausting salary or compensation to which they are entitled, pursuant to the California Military and Veterans Code, shall be entitled to salary augmentation not to exceed one hundred percent (100%) of their full County salary in combination with their military pay, for a period not to exceed 180 calendar days while engaged in the performance of ordered active military duty. For the purposes of this resolution, "called to active military duty" means ordered into active military duty as a member of a reserve component of the United States armed services, or ordered into federal duty as a member of the National Guard or Naval Militia. The County Administrator may, on an individual review and determination basis, extend this benefit for an additional period, not to exceed 180 calendar days. County salary augmentation is subject to mandatory deductions; voluntary deductions are optional. County employees who currently maintain life insurance, medical and/or dental benefits shall be entitled to continue said benefits, at their option and subject to contractual limitations, when they are called to active military duty. If employees called to active military duty choose to continue any or all of these benefits, the County will contribute at the customary rate and the employee will continue to be responsible for their share of the premiums, in accordance with County requirements. All costs associated with this resolution will be charged to the employee's department.
