SUBJECT: Approve the Parcel Map for Subdivision MS 18-98 being developed by Contra Costa
County Redevelopment Agency, Rodeo area.
The following document was presented for.Board approval this date:
The Parcel Map of Subdivision MS 18-98,property located in the Rodeo area,said map having been
certified by the proper officials;
Said documents were accompanied by:
I. Tax Letter
A. Letter from the County Tax Collector stating that there are no unpaid County
taxes heretofore levied on the property included in said map and that the
2000-2001 tax lien has been paid in full and that the 2001-2002 tax lien,
which became a lien on the first day of January 2001, is estimated to be
$0.00,
II. Grant Deed of Development Rights
B. In lieu of constructing the necessary improvements,the Contra Costa County
Redevelopment Agency is granting the development rights for Parcel"A"to
the County. These development rights will be quitclaimed back once the
improvements and related agreements are in place;

NOW THEREFORE BE IT RESOLVED that said subdivision,together with the provisions
for its design and improvement, is DETERMINED to be consistent with the County's general and
specific plans;
BE IT FURTHER RESOLVED that said Parcel Map is APPROVED((and this Board does
not accept or reject on behalf of the public any of the streets,paths or easements shown thereon as
dedicated to public use.))

GRANT DEED OF DEVELOPMENT RIGHTS
(Subdivision: MS980018)
In lieu of meeting condition of approval number 44 (maintenance agreement over the joint access
easement)and the requirement for construction of improvements or agreements and surety to insure
their construction (subdivision agreement and subdivision agreement bond) for Subdivision
MS980018, we, Contra Costa County Redevelopment Agency, (Owner) hereby grants to the
County of Contra: Costa, a political subdivision of the State of California (Grantee) and its
governmental successor or successors,the future development rights,as defined herein below over a
portion of that real property known as Parcel A of Subdivision MS980018 situated in the County of
Contra Costa, State of California, filed , in Book of
Parcel Maps,page , Contra Costa County Records, State of California.
Development rights are defined to mean and refer to the right to approve or disapprove of any
proposed construction,development or improvement within Parcel A(as previously described). The
development rights are and shall be a form of covenant,which shall run with the said property and
shall bind the current owner and any future owners of all or any portion of said property.In the event
of a disapproval of proposed construction by the Grantee or its successor,said proposed construction
shall not be performed. Grantee or its successor may condition its approval of any proposed
construction upon prior or subsequent performance of such conditions as Grantee may deem
appropriate.
The development rights will be "quitclaimed" back to the owner only when the conditions of
approval for Subdivision MS 980018 are satisfied. In particular this will require the recordation of a
maintenance agreement(as required by COA#44)and the construction or guarantee(in the form of
subdivision agreement and appropriate surety)of the improvements as required for this subdivision.
All as reviewed and approved by Contra Costa County Public Works Department.
