HomeMy WebLinkAboutRESOLUTIONS - 01012001 - 2001-427 C41 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on (date), by the following vote: AYES: Supervisors Gioia, Gerber, DeSaulnier, Glover and Uilkema NOES: None ABSENT: None ABSTAIN: None Resolution No. 2001/ 427 Subject: EMS Agency Access To Criminal History Information For Licensing, Or Certification Purposes) WHEREAS, Penal Code Sections 11105(b)(10) and 13300(b)(10) authorize cities, counties, and districts to access state and local summary criminal history information for employment, licensing, or certification purposes; and WHEREAS, penal Code Sections 11 105(b)(1 0)and 13300(b)(10) require that said access to state and local summary criminal history information be based upon a requirement or exclusion from employment, licensing, or certification based on specific criminal conduct on the part of the subject of the record; and WHEREAS, Penal Code Sections 11 105(b)(1 0) and 13300(b)(10) require the city council, board of supervisors, or governing body of a city, county, or district to specifically authorize access to summary criminal history information for employment, licensing or certification purposes; and WHEREAS, the Contra Costa Emergency Medical Services Agency conducts a certification program for Emergency Medical Technicians as authorized by Health and Safety Code Section 1797.210 NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors authorize the Contra Costa County Emergency Medical Services Agency and officials thereof to access summary criminal history information for licensing, or certification purposes; and BE IT FURTHER RESOLVED that the Board of Supervisors directs the Contra Costa County Emergency Medical Services Agency not to consider a person who has been convicted of a felony or misdemeanor involving moral turpitude for licensing or certification as an Emergency Medical Technician; except that such conviction may be disregarded if it is determined that mitigating circumstances exist, or that the conviction is not related to the license or certification-,in question.
