SUBJECT: Accept Completion of Improvements, Road Improvement Agreement for Chesley
Avenue, Grove Avenue, Market Avenue, Oh Street and 7th Street and Declaring
Certain Roads as County Roads,North Richmond area.
Assessor's Parcel Nos. 409-131-001; 002; 003;014; 015 & 019
The Public Works Director having notified this Board that the improvements for LP 2018-98
have been completed as provided in the Road Improvement Agreement with Mark R. Howe and
Susan P. Howe heretofore approved by this Board;

SUBJECT: Accept Completion of Improvements, Road Improvement Agreement for Chesley
Avenue, Grove Avenue, Market Avenue, 6th Street and 7th Street and Declaring
Certain Roads as County Roads,North Richmond area.

NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED
as of September 11,2001,thereby establishing the six-month terminal period for the filing of liens in
case of action under said Road Improvement Agreement:

June 6, 2000 Colonial American Casualty and Surety Company
BE IT FURTHER RESOLVED the payment(labor and materials)surety for$131,300.00 Bond No.
08170069 issued by Colonial American Casualty and Surety Company be RETAINED for the six
month lien guarantee period until March 11, 2002, at which time the Clerk of the Board is
AUTHORIZED to release the surety less the amount of any claims on file
BE IT FURTHER RESOLVED that the widening of Chesley Avenue and 7th Street and the
curb return at 6th Street and Grove Avenue are ACCEPTED and DECLARED to be County roads;
the right of way was conveyed by separate instruments, recorded on June 7, 2000, in DOC-2000-
0116771-00; DOC 2000-0116772-00; DOC-2000-0116773 and DOC-2000-0116774-00.
BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby
established, and the$1,300.00 cash deposit(Auditor's Deposit Permit No. 345309 dated February 15,
2000)made by MSH Management and the performance/maintenance surety for$131,300.00,Bond
No. 08170069 dated September 2, 1999,issued by Colonial American Casualty and Surety Company
be RETAINED pursuant to the requirements of Section 94-4.406 of the Ordinance Code until
released by this Board.
