The above-captioned project and the plans and specifications therefore having been
previously approved, Addenda No. I and 2 having been issued and approved, and bids having
been duly invited and received by the Director of General Set-vices on June 21, 2001; and
The Board having evaluated all of the documentation of the good faith effort by Fire
Innovations, Inc., to comply with the reqLIiI_CIllCIItS Of the COMAY'S Outreach and Mandatory
Subcontracting Minimum program; and
Fire Innovations, Inc. having failed to list in Its bid a certified and registered
subcontractor to perform asbestos-related work, but. having submitted the name of a certified and
registered subcontractor (.lanes Corporation, Contractor License No. 572682, DOSI I Registration
No. 224), and having given the County written assurance that all asbestos-related work on the
pro-icct will be performed by such certified and registered subcontractor, and
The Director of General Set-vices recommending that the bid listed above, Fire
Innovations, Inc. is the responsive and responsible bid, and further recommending that the Board
approve the assessment or a penalty in the aniOLIIIt Of $100-00, 111-11-SLIant to California Public
Contract Code Section 4110, for faill.11-C to lista certified asbestos abatement subcontractor to
perform asbestos-related work, and this Board concurring and so Finding;
NOW, 'VIIEREFORE, the Board finds, determines and orders as follows:
The Board DETERMINES that Fire Innovations, Inc. has demonstrated a good I'lith
effort, pt.11-Stlant to the specifications for this project, to comply with the requirements of the
COL111ty'S Outreach and Mandatory Subcontracting Minimum Program, and the Board WAIVES
any irregularities in such compliance; and
The Board ORDERS that the contractor pay a penalty in the amount of $100.00
according to Public Contract Code Section 4110 for failure to list a certified and registered
asbestos abatement subcontractor to perform asbestos-related work; and
The Board ORDERS that the contract for the furnishing of labor and materials for
this proicct is awarded to Fire Innovations, Inc. at the listed amount and at the prices SLIbIllittCd
in said bid, and that said contractor shall present two good and sufficient surety bonds as
indicated above, and that the General Services Department shall prepare the contract therefore;

FOR SUPERIOR COURT
The Board FURTHER ORDERS that after the contractor has signed the contract
and returned it, together with the bonds as noted above and any required certificates of insurance
or other required documents, and after the Director of General Services has reviewed and found
them to be sufficient, the Director of General Services is aL1tl10riZCd to sign the contract For this
Board; and
The Board FURTHER ORDERS that in accordance with the project
specifications and/or upon signature of the contract by the Director of General Services, any bid
bonds posted by the bidders are to be exonerated and any checks or cash submitted for security
shall be returned; and
']'lie Board 1'4UR'l'11ER ORDERS that the Director of General Services is
authorized to sign any escrow agreements prepared for this project to permit the substitution of
securities for moneys withheld by the County to ensure performance under the contract, pursuant
to Section 22300 of the Public Contract Code; and
Pursuant to Public Contract Code Section 4114, the Board DELEGATES its
functions under Public Contract Code Sections 4107 and 4110 to the General Services Director
or his designee.
