Amoroso 70 Gold Street San Francisco, CA 94113 West Bay Builders 615 Lindaro Street San Rafael, CA 94901 Ralph Larson and Son 507 O'Neil Avenue Belmont, CA 94002 The above-captioned project and the specifications therefor having been previously approved, Addendum A, B, and C having been issued and approved, and bids having been duly invited and received by the Office of the County Administrator on May 17, 2001; and The Board, on April 10,2001, having approved the issuance of a bid addendum extending the bid opening date to May 17, 2001 and requiring the successful bidder and all subcontractors to sign a project labor agreement("PLA")containing certain specified provisions as a condition of working on the project and as a material condition of the contract and contract award, and Addendum C having been issued pursuant thereto; and The bidder listed first above, Taber Construction ("Taber"), having submitted the lowest responsive and responsible bid; and The County Affirmative Action Officer having evaluated all of the documentation of good faith effort submitted by Taber and having reported that Taber has complied with the requirements of the County's Outreach Program; and The County Counsel's Office having reviewed the proposed PLA between Taber and the Contra Costa Building and Construction Trades Council and having reported that the PLA complies with requirements stipulated by this Board; and The County Administrator recommending that the bid submitted by Taber is the lowest responsive bid, and this Board concurring and so finding; AWARD OF CONTRACT TO TABER CONSTRUCTION FOR FAMILY LAW CENTER MARTINEZ, CALIFORNIA JULY 10, 2001 NOW, THEREFORE, the Board finds, determines and orders as follows: The Board DETERMINES that Taber as the lowest responsive and responsible bidder, has complied with the project specifications and requirements of the County Outreach Program, and the Board WAIVES any irregularities in such compliance; and The Board ORDERS that the contract for the furnishing of labor and materials for said work is awarded to Taber Construction at the listed amount (Base Bid and Alternate 1) and at the prices submitted in said bid, and that said contractor shall present two good and sufficient surety bonds as indicated above, and that the County Administrator shall prepare the contract therefor; and As a condition of the contract award,the Board FURTHER ORDERS that, before the contract is signed by the County Administrator or his designee, the previously-negotiated and approved PLA shall be signed by the contractor, the Contra Costa County Building & Construction Trades Council, and its constituent trade unions; and The Board FURTHER ORDERS that,after the contractor has signed the contract and returned it, together with the bonds as noted above and any required certificates of insurance or other required documents, and the County Administrator has reviewed and found them to be sufficient, the County Administrator or his designee is authorized to sign the contract for this Board; and The Board FURTHER ORDERS that, in accordance with the project specifications and/or upon signature of the contract by the County Administrator or his designee, any bid bonds posted by the bidders are to be exonerated and any checks or cash submitted for security shall be returned; and The Board FURTHER ORDERS that the County Administrator or his designee is authorized to sign any escrow agreements prepared for this project to permit the direct payment of retention into escrow or the substitution of securities for withheld funds, pursuant to Section 22300 of the Public Contract Code; and Pursuant to Public Contract Code Section 4114, the Board DELEGATES its functions under Public Contract Code Section 4107 and 4110 to the County Administrator or his designee; and Pursuant to Public Contract Code 20142 the Board DELEGATES to the County Administrator or his designee the authority to execute written change orders to the above referenced contract provided the additional cost for any single change order does not exceed $150,000; and Pursuant to Labor Code Section 6705,the Board FURTHER DELEGATES to any registered civil or structural engineer employed by the County the authority to accept detailed plans showing the design of shoring,bracing,sloping or other provisions to be made for worker protection during trench excavation covered by that section.
