Before this Board is a proposed agreement to establish the terms and conditions
of John Sweeten's employment as County Administrator of Contra Costa County. The
proposed agreement before the Board has been approved by John Sweeten. This
Board has reviewed and considered said proposed agreement.
Now, therefore, it is by the Board ordered, approved and directed that this
proposed agreement is hereby approved and the Board Chair shall execute it for
Contra Costa County.
I hereby certify that this is a true and correct copy of
an action taken and entered on the minutes of the
Board of Supervisors on the date shown.

RESOLUTION No. 2001/27
EMPLOYMENT AGREEMENT FOR
JOHN R. SWEETEN
The County of Contra Costa, a political subdivision of the State of
California, hereinafter referred to as "Employer" and John R. Sweeten,
hereinafter referred to as "Employee" in consideration of the mutual
promises made herein, agree as follows:
ARTICLE 1. TERM OF EMPLOYMENT
Section 1.01
Employer will employ Employee for a period commencing March 2,
2001 and continuing through February 29, 2004.
ARTICLE 2. DEVOTION TO EMPLOYER'S BUSINESS
Section 2.01
(a) Employee shall devote his attention to the business of the
Employer and as provided in Contra Costa County Ordinance
Code Chapter 24-4.
(b) This agreement shall not be interpreted to prohibit Employee from
making personal investments or conducting private business
affairs otherwise allowed by applicable statutes and regulations.
ARTICLE 3. OBLIGATIONS OF EMPLOYER
Section 3.01
General Description:
Employer shall provide Employee with the compensation, incentives
and benefits, specified elsewhere in the agreement, as well as
reimbursement of actual and necessary business expenses in the
same manner as provided other department heads.
Section 3.02
Office and Staff:
Employer shall provide Employee with a private office, secretary,
staff, office equipment, supplies and all other facilities and services
suitable to Employee's position and adequate for the performance of
his duties.
Section 3.03
Employer Indemnification:
In accordance with and subject to California's Tort Claims Act
(Government Code Section 825 et seq.), Employer shall defend and
indemnify Employee against and for all losses sustained by
Employee in direct consequences of the discharge of his duties on
the Employer's behalf for that period of his employment.

Section 7.02
Modifications:
Any modifications of this agreement will be effective only if it is in
writing and signed by both parties.
Section 7.03
Residency:
The County residency provisions of Government Code section 24001
and Contra Costa County Ordinance section 24-4.004 are hereby
waived for John Sweeten's appointment and service as County
Administrator. Employer finds that the best interests of the County will
be served by this waiver in that the current County Administrator has
announced his intention to retire from County service. Employer is
desirous of accomplishing a timely and smooth transition of
administrative leadership. Employee currently resides 2.75 miles
outside the County boundary. This waiver will permit Employer to
avoid paying relocation costs, and this waiver will permit Employee to
focus all his attention immediately on issues of concern to the County
without the substantial distractions that would otherwise unavoidably
attend a requirement to sell his existing home and purchase a new
home a very short distance away.
Section 7.04
Partial Invalidity:
If any provision in this agreement is held by a court of competent
jurisdiction to be invalid, void, or unenforceable, the remaining
provisions shall nevertheless continue in full force and effect without
being impaired or invalidated in any way.
