The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer required
for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets
and Highways Code, commencing with Section 8330, et. seq. A description of the portion to be
vacated is described in Exhibit "A" and shown as Exhibit "B" attached hereto and incorporated
herein by reference.
This vacation request is for an excess right of way of a street not required for street or
highway purposes. (S. & H. Code Section 8334).

SUBJECT: VACATION OF A PORTION OF STONE VALLEY ROAD & DETERMINE THAT THE
ACTIVITY IS NOT SUBJECT TO CEQA, PURSUANT TO ARTICLE 5, SECTION
15061 (B) (3) - CDD CP# 00-72.

This Board hereby FINDS that the proposed vacation will not have a significant effect on
the environment, and that it has been determined to be exempt from the California Environmental
Quality Act under State CEQA guidelines Section 15061 (b)(3) and DIRECTS the Director of
Community Development to file a Notice of Exemption with the County Clerk and DIRECTS the
Public Works Director to arrange for payment of the $25.00 handling fee to the County Clerk for
filing and a $25.00 fee to Community Development for processing of the Notice of Exemption.
The Board having considered the general plan, FINDS pursuant to Government Code Section
65402 that in accordance with its Resolution No. 81/522; this vacation is minor in nature and
therefore exempt from general plan conformance review.
This Board declares that the hereinabove described proposed vacation area is HEREBY
ORDERED VACATED subject to any reservation and exception described in attached Exhibit
"A". From and after the date this Resolution is recorded, the portion vacated no longer constitutes
a public highway.
The Real Property Division is ORDERED to record a certified copy of this Resolution in the
office of the County Recorder.

Being a portion of Stone Valley Road as described in the Deed To Contra Costa County
filed April 19, 1862 in Book 10 of Deeds at page 45; and a portion of that parcel of land
granted to Contra Costa County by Grant Deed filed December 27, 1968 in Book 5779
of Official Records at page 356; and a portion of that parcel of land granted to Contra
Costa County filed November 7, 1968 in Book 5746 of Official Records at page 153, in
the office of the Recorder of the County of Contra Costa, State of California, described
as follows:
Beginning at the southwesterly corner of that parcel of land granted to Pflum Family
Revocable Living Trust by quitclaim deed filed March 11, 1993 in Book 18341 of Official
Records, at page 744 records of said County, said point being on the northerly right of
way line of Stone Valley Road; thence from said Point of Beginning along said northerly
right of way line also being the southerly line of said Pflum parcel (18341 OR 744) north
82007'25" east 345.17 feet; thence leaving said northerly right of way line of Stone
Valley Road, south 1°11'53" east 50.07 feet; thence south 87037'54" west 134.98 feet;
thence south 89053'43" west 206.80 feet, thence northerly along the southerly
prolongation of the westerly line of said parcel (18341 OR 744) said line also being the
southerly prolongation of the easterly line of that parcel of land granted to Mohamad T.
Poustinchian by an instrument filed August 31, 1999, at series No. 99-233175, north
8029'04" west 8.81 feet to the Point of Beginning.
Containing an area of 10,626 square feet (0.248 acres) of land, more or less.
EXCEPTING THEREFROM: A ten feet in width storm drain easement described as
follows:
Commencing at the southeast corner of said Pflum parcel (18341 OR 744)
thence south 82007'25" west 68.16 feet to the Point of Beginning, thence from said
Point of Beginning south 7014'08" west 44.52 feet; thence south 87037'54" west 10.14
feet; thence north 7°14'08" east 43.53 feet; thence north 82°07'25" east 10.36 feet to
the Point of Beginning.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets
and Highways Code, the easement and right at any time, or from time to time, to
construct, enlarge, maintain, operate, replace, remove and renew those existing and in
place utilities, as of the date of recording this instrument, in, upon, over and across any
highway or part thereof proposed to be vacated, including access to protect the property
from all hazards, in, upon, and over the area herein before described to be vacated.
Bearings are based on the California Coordinate System Zone III.

Community Development staff has reviewed the attached project, CP 00-71Q to
determine if mandatory referral for General Plan Conformance, as required by Section
65402 of the Government Code, is necessary.
The project needs no further mandatory referral clearance from County staff subject to the
following actions:
( ) This project has been determined to be exempt from 65402 review.
N This project has been determined to be exempt from 65402 review in
accordance with the Board of Supervisors Resolution 81/522 because the
project involves a road alignment project of a minor nature.
( ) The project site is located within the City of and should
be referred to the City for 65402 review.
( ) The project site is located within the City of Our
Department does not review projects for General Plan Conformance (refer to
Government Code Section 65402) that are located within a City.
( ) Community Development staff makes the following attached recommendation
which should be incorporated into the staff report on this matter.

county's interest. Contra Costa County has an easement for road purposes affecting 2124
Stone Valley Road (APN 193-130-006) in Alamo. A portion of that easement (10,821 sq.
ft.) is no longer needed for road purposes, therefore the County wishes to terminate its
interest and reserve an existing ten feet in width storm drain easement along APN 193-
130-006.
LOCATION:
The activity is located at 2124 Stone Valley Road, southeast of Miranda Avenue and north
of Stone Valley Road, in the south county area near the town of Alamo. (Figures 1 —3).
