The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer required
for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter 4 of the Streets
and Highways Code, commencing with Section 3330, et. seq. A description of the portion to be
vacated is attached hereto as Exhibit "A" and incorporated herein by reference.
This vacation request is for an excess right of way for a street or highway not required for
street or highway purposes (S. & H. Code Section 3334).

This Board hereby FINDS that the proposed vacation will not have a significant effect on
the environment, and that it has been determined to be exempt from the California Environmental
Quality Act under State CEQA guidelines Section 15061 (b)(3) and DIRECTS the Director of
Community Development to 0le a Notice of Exemption with the County Clerk and DIRECTS the
Public Works Director to arrange for payment of the $25.00 handling fee to the County Clerk for
filing and a $25.00 fee to Community Development for processing of the Notice of Exemption. This
Board having considered the general plan, FINDS pursuant to Govemment Code Section 65402
that in accordance with its Resolution No. 81/522 this vacation is minor in nature and therefore
exempt from general plan conformance review.
This Board declares that the hereinabove described proposed vacation area is HEREBY
ORDERED VACATED subject to any reservation and exception described in attached Exhibit
"A". From and after the date this Resolution is recorded, the portion vacated no longer constitutes
a public highway.
The Real Property Division is ORDERED to record a certified copy of this Resolution in the
office of the County Recorder.

Real property in an unincorporated area of the County- of Contra Costa, State of
California, being a portion of the south 1/2 of the southwest % of the southwest 1/4 of
Section 4, Township 1 North, Range 3 East, Mount Diablo Meridian, being a portion of
the parcel of land described in the Grant Geed to Contra Costa County recorded
November 22, 1926, in Book 53 of Official Records at page 436 described as follows:
Commencing at the southwest comer of said Section 4; thence along the south line of
said Section 4, south 89°20'40" east (the bearing south 89°20'40" east being used for
the purpose of this description) 236.06 feet; thence leaving said south line of Section 4,
north 0°39'20" east 42.00 feet to a point on a line which lies 42.00 feet northerly and
parallel with the said south line of Section 4, said point being the Point of Beginning;
thence from said Point of Beginning, along said parallel line, north 89°20'40" west
158.87 feet; thence leaving last said line, north 4416'40" west 49.55 feet to a point on a
line which lies 42.00 feet easterly and parallel with the west line of said Section 4;
thence along said parallel line, north 0047'20" east 148.49 feet to a point from which a
radial line of a non-tangent curve, concave to the northeast, having a radius of 293.35
feet bears north 71 011'08" east, said point lying on the northeasterly boundary of said
Contra Costa County parcel (53 OR 436); thence southeasterly along the arc of said
curve and said Contra Costa County parcel, through a central angle of 54°05'03", a
distance of 276.91 feet to the Point of Beginning.
Containing an area of 11,418 square feet of land, more or less.
The Abutter's rights of access shall be relinquished along the following courses:
1) north 89°20'40" west 158.87 feet,
2) north 44016'40" west 49.55 feet,
3) north 0047'20"east 148.49 feet.
Bearings are based on the California Coordinate System of 1927 (CCS27), Zone 3.
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets
and Highways Code, the easement and right at any time, or from time to time, to
construct, enlarge, maintain, operate, replace, remove and renew those existing and in
place utilities, as of the date of recording this instrument, in upon, over and across any
highway or part thereof proposed to be vacated, including access to protect the property
from all hazards, in, upon, and over the area herein before described to be vacated.
This real property description has been prepared by me or under my direction, in
conformance with the Professional Land Surveyors Act.

SUBJECT: MANDATORY REFERRAL FOR GENERAL PLAN CONFORMANCE
Community Development staff has reviewed the attached project, CP 00- j to
determine if mandatory referral for General Plan Conformance, as required by Section
65402 of the Government Code, is necessary.
The project needs no further mandatory referral clearance from County staff subject to the
following actions:
{ ) This project has been determined to be exempt from 65402 review.
{+ This project has been determined to be exempt from 65402 review in
accordance with the Board of Supervisors Resolution 81/522 because the
project involves a road alignment project of a minor nature.
( ) The project site is located within the City of and should
be referred to the City for 65402 review.
{ ) The project site is located within the City of Our
Department does not review projects for General Plan Conformance (refer to
Government Code Section 65402) that are located within a City.
{ ) Community Development staff makes the following attached recommendation
which should be Incorporated into the staff report on this matter.
The project needs mandatory referral and County staff will process this project in the
following manner:
{ ) 65402 review is required. Community Development staff will carry this
matter before the appropriate Planning Commission.

DESCRIPTION OF THE AC IVIM
The activity consists of the termination of a roadway easement, and the quitclaim of the
county road interest on the easement. Contra Costa County has an easement, in which
it no longer needs, for public highway purposes affecting 2110 Eden Plains Road (APN
020-180-045). A portion of that easement (approx. 11,418 sq. ft.) is considered excess
and the applicant would like to use it.
LOCATION:
The activity is located on Eden Plains Road at Sunset Road, in the east county area near
the town of Knightsen. (Figures 1 —3).
