The Public Works Director has notified this Board that the improvements in Subdivision 7475 have been completed as provided in the Subdivision Agreement with DeNova Homes, Inc. heretofore approved by this Board in conjunction with the ding of the Subdivision Map. NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of August 15, 2000 thereby establishing the six-month terminal period for the filing of liens in case of action under said Subdivision Agreement: DATE OF AAGREF.MENT NAME.OF A 1 1J FTY December 15, 1998 Financial Pacific Insurance Company BE IT FURTHER RESOLVED the payment(labor and materials) surety for$154,550.00, Bond No. 5500215 issued by the above surety be RETAINED for the six month lien guarantee period until February 15, 2041, at which time the Cleric of the Board is AUTHORIZED to release the surety less the amount of any claims on file. BE IT FURTHER RESOLVED that the widening of San Pablo Dam Road and Greenridge Drive is ACCEPTED and DECLARED to be County Roads; the right of way was conveyed by separate instrument,recorded on December 24, 1998, in Boole 445 of Maps on page 1. RESOLUTION NO. : 2000/379 SUBJECT: Accept completion of Improvements and Declaring Certain Roads as County Roads, Subdivision 7475, El Sobrante area, DATE: August 15, 2000 PAGE: 2 BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby established, and the $3,200.00 cash deposit (Auditor's Deposit Permit No. 323483, dated November 30, 1998) made by DeNova Homes, Inc., shall be RETAINED pursuant to the requirements of Section 94-4.405 of the Ordinance Code until released by this Board. BE IT FURTHER RESOLVED that the performance/maintenance surety for$317,900,00, Bond No. 5500215 issued by Financial Pacific Insurance Company be RELEASED and REPLACED by a fifteen percent maintenance bond for $47,585.00, Bond No. 5502334 (dated March 24,2000)issued by Financial Pacific Insurance Company as specified in the Ordinance Code.
