HomeMy WebLinkAboutRESOLUTIONS - 01012000 - 2000-260 Consider w/C.88 IN THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, STATE OF CALIFORNIA ADOPTED this order on Mal 23, 2000 by the following vote: AYES: SUPERVISORS GIOIA, UILKEMA, neSAULNIER and CANCIAMILLA NOES: NONE ABSENT: SUPERVISOR GERBER ABSTAIN: NONE RESOLUTION NO. 20001 2 6 0 SUBJECT: Determination of Property Tax ) Transfer for Proposed Reorganization of the Bethel Island and ) Oakley Fire Protection Districts (LAFC 00-16) 1 WHEREAS,Section 99.01 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not been provided previously shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS,the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer for the annexing district; and WHEREAS, the proposed Reorganization of the Bethel Island and Oakley Fire Projection Districts (LAFC 00-16) involves the detachment of territory from the Oakley Fire Protection District (OFPD) and the concurrent annexation of said territory to the Bethel Island Fire Protection District (BIFPD), which will affect the service responsibilities of the Districts; and WHEREAS, the Board of Supervisors acting as the governing board of the Oakley and Bethel Island Fire Protection Districts has requested in Resolution 2000-162 that the Local Agency Formation Commission of Contra Costa County concurrently approve the detachment of the territory of the Oakley Fire Protection District contained within the southern portion of subdivision 7562 (known as the Cypress Lakes and Country Club Project) and approve the annexation of the detached portion to the Bethel Island Fire Protection District; and WHEREAS, the reorganization that involves the detachment of territory from OFPD and the concurrent annexation of the territory to the BIFPD will result in the transfer of property tax from OFPD to the BIFPD; NOW, THEREFORE, BE IT RESOLVED THAT THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY HEREBY DETERMINES that 100 percent of the property tax revenue accruing to Oakley Fire Protection District from the affected territory shall be transferred to the Bethel Island Fire Protection District for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdiction change. Said transfer shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. Said tax transfer apply to affected territory as submitted or revised by the Local Agency Formation Commission. This resolution does not change the property tax revenue accruing to other agencies serving the subject territory or the affected districts'right to collect taxes for existing bonded indebtedness. The following documents were presented for Board approval this date: I. Map The Final Map of Subdivision 8262, property located in the Alamo area, said map having been certified by the proper officials; VI. Subdivision Agreement A subdivision agreement with Sherman Ranch L.L.C., subdivider, whereby said subdivider agrees to complete all improvements as required in said subdivision agreement within one year from the date of said agreement. Accompanying said subdivision agreement is security guaranteeing completion of said improvements as follows: A. Cash Deposit Deposit amount: $2,800.00 Deposit made by: Sherman Ranch L.L.C. Tax ID No.: 94-3300943 Auditor's Deposit Permit No. and Date: 349201 on April 28, 2000 B. Surety Bond Bond Company: American Contractors Indemnity Company Bond Number and Date: 89138 dated October 14, 1999 Performance Amount: $278,000.00 Labor&Materials Amount: $140,400.00 Principal: Sherman Ranch, L.L.C. Attached is an Increase Rider by the American Contractors Indemnity Company dated April 11, 2000, increased the performance amount to $281,600.00 and Labor and Material amount to $142,200.00. The principal is the same as above. RESOLUTION NO. : 2000/261 SUBJECT: Approval of the Final Map and Subdivision Agreement for Subdivision 8262,Alamo area. DATE: May 23, 2000 PAGE -2- VII. Tax Letter Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 19992000 tax lien has been paid in full and the 2000-2001 tax lien,which became a lien on the first day of January 2000, is estimated to be $33,500.00, with security guaranteeing payment of said tax lien as follows: • Tax Surety Bond Company: American Contractors Indemnity Company Bond Number and Date: 89164 dated April 12, 2000 Amount: $33,500.00 Principal: Sherman Ranch, L.L.C. NOW THEREFORE BE IT RESOLVED that said subdivision,together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans; BE IT FURTHER RESOLVED that said Final Map is APPROVED and this Board does not accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use. All deposit permits are on file with the Public Works Department. BE IT FURTHER RESOLVED that said subdivision agreement is also APPROVED.
