HomeMy WebLinkAboutRESOLUTIONS - 01012000 - 2000-220 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA AS THE GOVERNING BOARD OF THE CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT Adopted this Resolution on May 9, 2000 by the following vote: AYES: SUPERVISORS GIOIA, UIIXM4A, DESAULNIER, CANCIAMILLA and GERBER NOES: NONE ABSENT: NONE ABSTAIN: NONE RESOLUTION NO. 2000F.220 SUBJECT: ESTABLISHMENT OF STORMWATER UTILITY AREA 18 (OAKLEY)AND IMPOSITION OF ANNUAL ASSESSMENT, Project No. 4500-6X7181-CDD CP #95-37 The Board of Supervisors of Contra Costa County, as the Governing Body of the Contra Costa County Flood Control and Water Conservation District, RESOLVES THAT; The Contra Costa County Flood Control and Water Conservation District Act, hereinafter referred to as Act, provides authority for said Governing Body to establish Stormwater Utility areas, and adopt ordinances and resolutions for Stormwater Utility Assessments; and This Board on June 22, 1993, established Stormwater Utility Area 17 — (Unincorporated County) consisting of that real property located in the unincorporated County; and On April 4, 2000, this Board adopted a resolution proposing to form Stormwater Utility Area 18 (Oakley) and to impose annual assessments therein for the purpose of paying for the costs of activities undertaken, or to be undertaken, in connection with the national pollutant discharge elimination system (NPDES) program; and Pursuant to Section 12.8 of the Contra Costa County Flood Control and Water Conservation District Act, a written report describing the proposed assessments and the lots, parcels or classes of property proposed to be subject to the assessments has been filed with the Clerk of the Board; and On April 18, 2000, the Contra Costa County Board of Supervisors adopted a resolution accepting the removal of SUA 18 (Oakley)consisting of the real property in the incorporated limits of the City of Oakley from SUA 17 (Unincorporated County); and On May 9, 2000, this Board held public hearings to hear public testimony and to consider all objections or protests to the written report and the proposed formation of said Stormwater Utility area and the adoption of a resolution imposing annual assessments; and It appears from the affidavits of publication on file with this Board that all notices required to be given for such hearings have been duly and regularly given and all procedures to be followed have been followed, all in accordance with Section 11 and 12.8 of the Contra Costa County Flood Control and Water Conservation District Act and Section 54954.6 of the Government Code; and SUBJECT: ESTABLISHMENT OF STORMWATER UTILITY AREA 18 (OAKLEY)AND IMPOSITION OF ANNUAL ASSESSMENT DATE: May 9, 2000 PAGE: 2 This Board has received a copy of a resolution approved by a majority of the members of the Oakley City Council requesting formation of said Stormwater utility area and the adoption of an annual assessment rate of$20.65 per Equivalent Runoff Unit (ERU) for their jurisdiction for Fiscal Year 2000-01. This Board FOUND that the activity, adoption of a resolution imposing Stormwater Utility Assessments and adjustments based on equivalent runoff units are not subject to the California Environmental Quality Act (CEQA) pursuant to Article 5, Section 15061(b)(3) of the CEQA guidelines on June 13, 1995. A Notice of Exemption was filed on June 14, 1995. This Board hereby FORMS and ESTABLISHES Stormwater Utility Area 18, consisting of the real property located within the unincorporated limits of the City of Oakley, as shown in the records on file with the Local Agency Formation Commission, as amended from time to time to reflect annexations and detachments; and This Board FINDS that the proposed assessment rate for Stormwater Utility Area 18 does not exceed the maximum annual assessment rate of$30.00 per ERU established for the area; and This Board, in accordance with Ordinance No. 93-47, ADOPTS this resolution of annual assessments for Fiscal Year 2000-01 within Stormwater Utility Area No. 18 based on the rate of$20.65 per ERU. This Board hereby DIRECTS the Chief Engineer to file with the County Assessor and the County Auditor/Controller a list of the parcels subject to the assessment levied for Fiscal Year 2000-01; and This Board hereby DIRECTS the Clerk of the Board to file with the County Assessor and the County Auditor/Controller a certified copy of this resolution.
