HomeMy WebLinkAboutRESOLUTIONS - 01012000 - 2000-164 THE BOARD OF SUr ERVISORS OF CONTRA COSTA UJUNTY, CALIFORNIA AS THE GOVERNING BOARD OF THE CONTRA COSTA COUNTY FLOOD CONTROL AND WATER CONSERVATION DISTRICT Adopted this Resolution on April 4, 2000 by the following vote: AYES: SUPERVISORS GIOIA, UILKEMA, DESAULNIER, CANCIAMILLA, AND GERBER NOES: NONE ABSENT: NONE ABSTAIN: NONE RESOLUTION NO. 20001 164 SUBJECT: Notification of Hearing to Consider Establishment of Stormwater Utility Area No. 18, and the Adoption of a Stormwater Utility Assessment, Oakley The Board of Supervisors of Contra Costa County, as the Governing Body of the Contra Costa County Flood Control and Water Conservation District, RESOLVES THAT; The Contra Costa County Flood Control and Water Conservation District Act, hereinafter referred to as Act, provides authority for said Governing Body to establish Stormwater Utility areas, and adopt ordinances for Stormwater Utility assessments; and This Board has before it for consideration the proposed establishment of Stormwater Utility Area 18 — (Oakley) consisting of that real property located in the incorporated limits of Oakley. The area within Stormwater Utility Area 18 was formerly within Stormwater Utility Area 17 — (Unincorporated County). The establishment of Stormwater Utility Area 18 will separate and exclude the incorporated limits of Oakley from Stormwater Utility Area 17 — (Unincorporated County); and This Board also has before it the Engineer's Report providing an estimate of the cost of the Stormwater facility maintenance and National Pollutant Discharge Elimination System (NPDES) permit activities to be borne by property in Stormwater Utility Area 18. This Board also has before it the Chief Engineer's report entitled "Report on Stormwater Utility Assessment" which presents the proposed method for equitably assigning the program costs to the benefiting properties. Both reports are on file with, and may be examined at the Office of the Clerk of the Board of Supervisors, Administration Building, Martinez, California. It is proposed that Stormwater Utility Area 18 be established and that Stormwater Utility Assessment for Fiscal Years 2000-01 be adopted; and At 9:00 a.m. on May 9, 2000, in the Chambers of the Board of Supervisors, Administration Building, Martinez, California, this Board will conduct public hearings on the proposed establishment of said Stormwater Utility area and the adoption of the Fiscal Year 2000-01 Stormwater Utility assessment. At the hearing, the Board will hear and pass upon any and all written or oral objections to the establishment of Stormwater Utility Area 18 and the adoption of the proposed Fiscal Year 2000-01 Stormwater Utility Assessment. Upon conclusion of the hearing, the Board may abandon the proposed actions, or proceed with the same. The Clerk of the Board is DIRECTED to publish a Notice of Hearing, pursuant to Government Code 6066, once a week for two (2) successive weeks prior to the hearing in the Antioch Daily Ledger, a newspaper of general circulation, circulated in areas proposed to be formed into said Stormwater Utility area and to to adopt Fiscal Year 2000-01 Storm Water Utility Assessment. Publication shall be completed at least seven (7) days before said hearing and said notice shall be given for a period of not less than twenty (20) days. The exterior boundaries of the Stormwater Utility Area include lands within the City of Oakley. The Clerk of this Board is DIRECTED to forward to the governing body of Oakley a copy of this Resolution at least twenty (20) days before the above noted hearing. The mailing addresses and individual recipients are listed in the attached Exhibit A. The Clerk of the Board is further DIRECTED to mail a copy of the Notice of Public Hearing to any interested party who has filed a written request for mailed notice with the Clerk of the Board or with the District.
