ACCEPT the Petition for annexation to the existing Wiedemann Ranch Geologic Hazard Abatement District(GHAD), and 2. ADOPT the Resolution SETTING the hearing date initiating the proceedings on the proposed annexation to the Wiedemann Ranch GHAD on Tuesday,April 11,2000,at 10:00 a.m. in Room 107 of the Board of Supervisors' Chambers, 651 Pine Street, Martinez, California, as the time and place for a public hearing to consider oral and written objections or comments concerning the Wiedemann Ranch GRAD. PROJECT NUMBER 6X5010. DATE: MARCH 21, 2000 PAGE 2 II. Financial Impact: There will be no impact to the General Fund. All costs will be covered with revenue generated through parcel assessments for the GHAD. III. Reasons for Recommendations and Background: William Lyon Homes, Inc. (formerly Presley Homes) is in the process of obtaining final map approval to develop certain property located within the Henry Ranch (the"Henry Ranch Project"). The Henry Ranch Project is a 91.49 acre area within the City of San Ramon that William Lyon Homes, Inc. plans to develop into 100 residential units. Under Condition 28 of the City of San Ramon conditons of approval (City Planning Commission Resolution 80-99) for the Vesting Tentative Map and Development Plan, William Lyon Homes, Inc. is required to petition for formation of a Geologic Hazard Abatement District("GHAD") or for annexation into an existing GHAD for the purpose of undertaking all site-related geotechnical repair work. The GRAD will mitigate or abate landslide or erosion hazards that could directly affect improved, developed, and accepted properties within the Henry Ranch Project. The Henry Ranch Project has a common boundary with Wiedemann Ranch; furthermore,property within the Henry Ranch Project has geologic conditions that are similar to those in the Wiedemann Ranch. Consequently, the Henry Trust, current owners of the Henry Ranch Project property, filed a Petition for Annexation of Territory to the Wiedemann Ranch GHAD on February 23, 2000. Annexation of territory to a GHAD must also be approved by the legislative body that ordered formation of the existing GRAD. § 26581. On September 1, 1998, the Contra Costa County Board of Supervisors ordered by resolution the formation of the Wiedemann Ranch GHAD. Therefore, after the GHAD Board orders the annexation, the Contra Costa County Board of Supervisors must approve the annexation by resolution. IV. Consequences of Negative Action: The development will not proceed without the condition of approval to form a GRAD being met. This resolution is made pursuant to Division 17 (Sections 26500 et seq.)of the Public Resources Code. 2. On March 21,2000 the Board was presented with the Petition for Annexation of Subdivision,Tract 7822 to the Wiedemann Ranch Geologic Hazard Abatement District("GHAD Petition"), including a plan of control ("Plan of Control").Upon recommendation of the GHAD General Manager,the Board concludes that the GHAD Petition(and Plan of Control)is substantially in the form described in Section 26551 and 26552 of the Public Resources Code. 3. The Board has reviewed the Plan of Control presented to it with the GHAD Petition and determined that the health, safety,and welfare issues required in the formation of the proposed district,were adequately addressed. 4. The Board will conduct a public hearing(the"Hearing")on the proposed annexation of the project into the existing Wiedemann Ranch GHAD on April 11,2000 at 10:00 a.m. in Room 107 of the Board of Supervisors' Chambers, 651 Pine Street,Martinez, California 94553. At the Hearing, any objections to the proposed formation shall be presented. 5. Notice of the Hearing shall be mailed to each owner of real property to be included within the proposed district as shown on the assessment roll last equalized by the County. Notice of the Hearing shall be mailed first-class,postage prepaid, in the United States mail and postmarked not less than 20 days preceding the date of the Hearing. Notice of the hearing shall include a copy of the GHAD Petition. Notice of the Hearing shall indicate where the Plan of Control may be reviewed or duplicated. Notice of the Hearing shall also set forth the address where objections to the proposed formation may be mailed or otherwise delivered up to and including the time of the Hearing. 6. At any time not later than the time set for hearing objections to the proposed formation, any owner of real property within the proposed district may make a written objection to the formation. Such objection shall be in writing, shall contain a description of the land by lot,tract,and map number, and shall be signed by such owner. Objections shall be mailed or delivered as specified in the notice procedure in Paragraph 5 of this Resolution.
