THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Order on January 18, 2000 by the following vote:

SUBJECT: Authorizing the filing of applications for Federal Surface Transportation
Program and Congestion Mitigation and Air Quality Improvement Program
funding for Pacheco Boulevard Overlay Phase II, Pacheco Boulevard
Overlay Phase III, San Pablo Dam Overlay Phase II, Treat Boulevard
Overlay, Willow Pass Road Overlay, and FY 2000/2001 Countywide
Sidewalk Gap Closure and committing the necessary local match for the
projects and stating the assurance of Contra Costa County to complete the
project
WHEREAS, the Transportation Equity Act for the 21st Century (TEA 21) (Public
Law 105-178, June 9, 1998) and the TEA 21 Restoration Act (Public Law 105-206, July 22,
1998) continue the Surface Transportation Program (23 U.S.C. § 133 and the Congestion
Mitigation and Air Quality Improvement Program (CMAQ) (23 U.S.C. § 149); and
WHEREAS, pursuant to TEA 21, and the regulations promulgated thereunder,
eligible project sponsors wishing to receive Surface Transportation Program or Congestion
Mitigation and Air Quality Improvement Program grants for a project shall submit an
application first with the appropriate metropolitan transportation planning organization
(MPO), for review and inclusion in the MPO's Transportation Improvement Program (TIP);
and
WHEREAS, the Metropolitan Transportation Commission is the MPO for the San
Francisco Bay region; and
WHEREAS, Contra Costa County is an eligible project sponsor for Surface
Transportation Program or Congestion Mitigation and Air Quality Improvement Program
funds; and

WHEREAS, Contra Costa County wishes to submit grant applications to MTC for
funds from the Surface Transportation Program or Congestion Mitigation and Air Quality
Improvement Program in fiscal year 1999-2000 for the following projects:
Pacheco Boulevard Overlay Phase 11 —Wygal Drive to Arthur Road
This project consists of placing a 75-mm thick overlay, restriping the road, widening
the road where there is inadequate shoulder (2.4m), and making minor storm drain
modifications.
Pacheco Boulevard Overlay Phase III
This project consists of placing a 75-mm overlay to the existing pavement on
Pacheco Boulevard from Blum Road to 2"d Avenue South, restriping the street, and
constructing sidewalk behind the existing curb from Blum Road to Muir Road.
San Pablo Dam Overlay Phase II
This project is a continuation of the Cycle I San Pablo Dam Road Overlay, which
started at the Richmond City Limit, proceeded south towards Orinda, and consists
of placing a 75-mm thick overlay, replacing the AC dikes, and restriping the road.
Treat Boulevard Overlay
This project consists of minor road base failure repair, replacement of three curb
ramps, placement of a 75-mm overlay to the existing pavement on Treat Boulevard
between Buskirk Avenue and the Walnut Creek Channel, restriping the street, and
constructing sidewalk behind the existing curb from Buskirk Avenue and the end of
the existing sidewalk near Oak Road.
Willow Pass Road Overlay
This project consists of base failure repair, crack filling, and overlaying Willow Pass
Road from Bailey Road to the Pittsburg City Limit with 75-mm of asphalt concrete.
FY 2000/2001 Countywide Sidewalk Gap Closure
This project consists of constructing sidewalks in locations that will connect existing
sections of sidewalks, where needed the project will construct curbs and widen the street.
The locations are throughout the County

WHEREAS, MTC requires, as part of the application, a resolution stating the
following:
1) the commitment of necessary local matching funds of at least 11.5%; and
2) that the sponsor understands that the Surface Transportation Program and
Congestion Mitigation and Air Quality Improvement Program funding is fixed at the
programmed amount, and therefore any cost increase cannot be expected to be
funded with Surface Transportation Program or Congestion Mitigation and Air
Quality Improvement Program funds; and
3) the assurance of the sponsor to complete the project as described in the
application, and if approved, as programmed in MTC's TIP; and
4) that the sponsor understands that funds must be obligated by September 30, 2002
for non-operating projects and September 30, 2003 for operating projects, or the
project may be removed from the program.
NOW, THEREFORE, BE IT RESOLVED by the Board of Supervisors that Contra
Costa County is authorized to execute and file applications for funding under the Surface
Transportation Program or the Congestion Mitigation and Air Quality Improvement Program
of TEA 21 in the amount of $3,059,000 for the following projects Pacheco Boulevard
Overlay Phase II, Pacheco Boulevard Overlay Phase III, San Pablo Dam Overlay Phase
11, Treat Boulevard Overlay, Willow Pass Road Overlay, and FY 2000/2001 Countywide
Sidewalk Gap Closure; and
BE IT FURTHER RESOLVED that the Board of Supervisors by adopting this
resolution does hereby state that:
1) Contra Costa County will provide $397,500 in local matching funds; and
2) Contra Costa County understands that the Surface Transportation Program and
Congestion Mitigation and Air Quality Improvement Program funding for the projects
is fixed at $3,059,000, and that any cost increases must be funded by the Contra
Costa County from local matching funds, and that Contra Costa County does not
expect any cost increases to be funded with Surface Transportation Program or
Congestion Mitigation and Air Quality Improvement Program funds; and

3) The Pacheco Boulevard Overlay Phase II, Pacheco Boulevard Overlay Phase III,
San Pablo Dam Overlay Phase II, Treat Boulevard Overlay, Willow Pass Road
Overlay, and FY 2000/2001 Countywide Sidewalk Gap Closure projects will be built
as described in this resolution and, if approved, for the amount shown in the
Metropolitan Transportation Commission (MTC) Transportation Improvement
Program (TIP)with obligation occurring within the timeframe established below; and
4) The program funds are expected to be obligated by September 30, 2002 for non-
operating projects and by September 30, 2003 for operating projects.
BE IT FURTHER RESOLVED that a copy of this resolution will be transmitted to the
MTC in conjunction with the filing of the application; and
BE IT FURTHER RESOLVED that the MTC is requested to support the application
for the project described in the resolution and to program the project, if approved, in MTC's
TIP.
