Recommended Action: Resolution 99/143 APPROVE changes to the Rules&Regulations for Use of the MonTaraBay Community Center and increases in rental fees,the additional hourly use rate and the cleaning/damage deposit. H. Financial Impact: There is no impact to the General Fund. Revenue generated from rental fees helps to pay for the maintenance and operation of the recreational facilities in County Service Area M-17. III. Reasons for RecommendatioLs and Background The fees associated with rental of the MonTaraBay Community Center have not been increased in over 10 years. Based on a survey of other comparable rental facilities throughout the County, it is recommended an increase in the rental fees,additional hourly use rate and the cleaning/damage deposit(see attached report). It is also recommended various changes and additions be made to the Rules&Regulations for Use-of the MonTaraBay Community Center(see attached proposed rules). The intention of this action is to address noise impacts to the surrounding neighbors,the use of alcoholic beverages,youth group rentals, and the County's liability exposure. Conseguences of Negative Action: Without these changes to the R—ulcs&RggglationsrLJsr.ofe M n a$a rn uniCenter, the volume of sound outside the center will continue to interfere with the neighbor's right to quiet enjoyment of the surrounding area. These changes will help to ensure that the use of the community center does not intrude on the neighbors. Current rental rates make it difficult for the service area to generate enough revenue to pay for maintenance of the building and the equipment. Increased rental fees will help provide the revenue needed to adequately maintain the rental facility. J / J / / J / / J J / I / / J / 1 / J _ 1 I f I RESOLUTION NO. 99/ 143 I f RENTAL FACILITIES SURVEY OVERVIEW AND PROPOSED CHANGES Staff contacted seventeen(17)rental facilities in Contra Costa County to obtain information regarding how they manage their facilities and how they have addressed problem areas encountered in the course of operating their rental facilities. Below is a synopsis of the information gathered as it pertains to the operation of the MonTaraBay Community Center and the other rental facilities managed by the Public Works Department. 1. RENT a. Seventeen(17)facilities were polled(including MonTaraBay Community Center). b. Of the 17 facilities, 11 had similar capacities to MonTaraBay Community Center, ranging from 100 - 150 people. c. City of Martinez- Sierra Room Sierra Roam (Capacity 110- 185) $60/hr. resident $200 $70/hr. non-resident $90/hr. corporate PROPOSED CHANGE.- The HANGE:The rent and cleaning/damage deposit at the MonTaraBay Community Center has not been raised in over I0 years. Based upon the research of the various other rental facilities throughout the County, an increase in the rental fees, additional hourly use rate and cleaningldamage deposit are proposed as follows: INCREASE"RENT.- CLEANINGIDAMAGE DEPOSIT. NOISE RULES Of the seventeen(17) facilities that were polled, only three (3) facilities specifically developed rules to address loud noise, amplified music or disturbances caused as a result of the renter's use of the facility as it relates to noise. PROPOSED RULE: Charge an additional 200 refundable noiseldisturbance deposit for thane rentals ending mer 10:00 p.m. The intent of this proposed new rule and fee(as proposed by Supervisor Uilkema) is to decrease or eliminate the disturbance to the neighbors caused by noise emanating from the facility after 10:00 p.m.. Supervisor Uilkema suggested that renters submit an additional$200 Noise Deposit. If the Sheriffs Department was called to quiet a rental,the renter will automatically forfeit the $200 noise/disturbance deposit and the rental could be terminated immediately. The drawback to this proposed rule is twofold. Firstly,this rule relies on the neighbors to hear the noise(and thus be disturbed by the noise) and then call the Sheriff's Department to restore quiet. With the proposed rule,the renter would then forfeit the $200 noise/disturbance deposit because the Sheriff s Department was called. However,the intent of this rule was to prevent the neighbors from being disturbed by noise after 10:00 p.m. This rule would not prevent this circumstance,but would actually rely on the neighbors to hear the noise. Secondly,the logistics of actually enforcing this rule could be troublesome. Renters could, and have successfully argued,that strangers (who were not a part of the renters event)were actually the ones who were playing their music loud. These individuals park either in the MonTaraBay parking lot or on the railroad property and play their car stereos quite loudly. The neighbors, only able to hear the noise and not visually see the cause of the noise, assume the noise is emanating from a rental at MonTaraBay. In fact, on occasion,the neighbors have complained about noise they assumed was coming from the Center,but the building was vacant. In all fairness,renters should not be penalized for noise impacts unrelated to rentals at the Center. PROPOSED CHANGE: a. Charge an additional$200 reLundable noiseldisturbance deposit,for those rentals ending at or after 10:00 p.m. and serving alcoholic beverages. b.Require Security guards on the premises throughout the entirety of all rentals where alcoholic beverages are either served or sold(see#4 below1. The use of a security guard service could prevent rentals from becoming loud and disturbing the neighbors. If a rental became unruly,the guard would call the Sheriffs Department for assistance. The use of security guards would also help to prevent damages to the Center. Moreover, if someone was drinking or playing music in the parking lot(see#4 below),the security guard would be responsible to address these individuals,and if needed,call the Sheriff. This recommendation puts the responsibility on the security guard(not the neighbors)to take the actions necessary to quiet the noise. 3. HOURS OF OPERATION Most facilities required that events end earlier than is presently required at MonTaraBay Community Center. At present,the allowable hours of use at MonTaraBay are as follows,rentals on Saturdays may be any 10 hours between the hours of Sam to 2 a.m.. Rentals on Fridays and Sundays may be any 10 hours between the hours of 10a.m. to midnight. Below is a count of the various rental facilities(including MonTaraBay Community Center) and the latest hour renters can use the facilities: Renter out by midnight Renter out by 1:00 a.m. Renter out by 2:00 a.m. 7 4 3 PROPOSED CHANGE: L Rentals on Saturdays end at 12:00 mm {midnight) instead of2.00 a.rn. This time change would, in essence,have the rental actually ending between 10:30 p.m.to 11:00 p.m. Renters would have to have the hall cleaned, and all of their guests, caterers,musicians, equipment and belongings removed 2 from the Center by 12:00 a.m. If they stayed past midnight, they would be charged the Additional Hourly Rate (see #2 below). 2 Increase the Additional Hourly Use Date after 12:00 a.m. Staff has recommended an increase in the Additional Hourly Rate previously in this report for the hours prior to midnight. However, those renters who stay past midnight would be penalized at a rate twice that of the Additional Hourly Rate prior to midnight. SECURITY GUARD REQUIRED Of the 17 facilities polled, 11 required security guard personnel. Three of the facilities required security personnel based on the number of people planned to attend the event(i.e. if over 100 people are to attend, etc.). Three(3) other facilities required a security guard if alcoholic beverages (more than a toast)were to be served or sold. STAFF ON PREMISES DURING RENTALS Of the 17 facilities polled, 7 required a custodian/caretaker on the premises throughout the duration of all rentals; 7 facilities did not assign staff to be on the premises during rentals. However, the majority of those facilities that did require a custodian/caretaker on the premises also allowed the rentals to end at 1:00 a.m. or later. There was not a clear-cut pattern and it is not recommended to have non-trained personnel on-site throughout the duration of the rentals. P.ROPQSED CLEANGE. curity guard required for all rentals where alcoholic beverages are either served or.sold When damages occur to the building or when the music becomes loud or fights break out, quite frequently,the consumption of alcoholic beverages is a contributing factor.'Use of a security guard firm,paid for by the renter, but contracted and assigned by the Public Works Department staff, could considerably reduce the frequency of these types of incidences. Theonsum ttt ion ofalcoholic beverages is not allowed anywhere outside ofthe building. Many times the overflow crowd from the parties end up in the parking lot. This type of occurrence can become loud and disruptive to the neighborhood and would be classified as a public nuisance. In the existing rules under section entitled, "General Regulations," rule#6 states, "Any person or persons violating the established Rules&Regulations and/or constituting a public nuisance may be required to leave the facility and will not be entitled to any refunds." This rule would be changed to read, "Any person or persons violating the established Rules &Regulations and/or constituting a public nuisance may be required to leave the facility and the renter may forfeit their entire cleaningldamage deposit." Not allowing the consumption of alcoholic beverages outside of the building combined with the possibility of forfeiting their entire cleaning/damage deposit may help to strengthen existing rule#6. S. YOUTH GROUP RENTALS Most rental facilities had developed rules to regulate youth group rentals. The ratio of chaperones to youth is generally 1:10, as are our rales. However, a significant difference is that one hall required that the chaperones be 25 years of age or older. Our rules only require the chaperones be 21 years of age or older. The drawback with our rule is that we have occasionally had 21 year olds chaperoning a party for an 18 year old-that marginally constitutes chaperoning. PR CHANGE. Make the following changes to the rules regarding rentals intended for minors as follows: Change existing.Rule#1 as follows: Groups composed of minors must be supervised by one (1)parem adult for each ten (10) minor children at all times while they are using the facility. 3 Change existing Rule#5 as follows: Renters failing to have designated chaperones present or the appropriate ratio of adults (24yeaff 25 years of age or older) to children present during their rentalperiod, may result in immediate termination of the rental and forfeiture of the entire cleaning/damage deposit. 6. LIABILITY INSURANCE REQUIRED Of the 17 facilities polled, 5 required the renter to have liability insurance. A minimum of one million dollar liability coverage was generally required. In some instances the renter could add a rider onto his/her homeowner's insurance policy and provide proof to the facility within 45 days of their event. Other facilities required that they purchase the coverage directly from the facility. PROPOSED CHANGE: Renters intending to sell or serve alcoholic beverages are required to provide a Certificate of Liability Insurance in the amount of one million dollars and naming the County of Contra Costa as additional insured. The Certificate of Insurance must be received a minimum of 14 days prior to the date of the rental Failure to provide insurance coverage within the specified time will result in cancellation of the rental and forfeiture of all fees. Risk Management recommends that, minimally, we require anyone renting an of our County facilities and planning to sell or serve alcoholic beverages be required to provide proof of liability coverage in the amount of one million dollars and name the County as additional insured .Potential renters can either add a rider onto their existing homeowner's insurance policy or contact Risk Management or their own insurance carrier to obtain the coverage. Coverage through Risk Management costs approximately$115 for events with 100 people or less and costs approximately$140 for events with 101 to 500 people. Based on Risk Management's recommendation it is proposed that the following language be added to the Rules c& Regulations for Use of the MonTaraBay Community Center, as well as, the other rental facilities that the Public Works Department operates: 4 If all of the proposed rate increases are enacted,below are samples of the typical costs for rental of the MonTaraBay Community Center. When you make your reservation you will be required to pay a refundable clewing and damage deposit. For your protection,you should make a pre- event inspection of the premises and notify the MonTaraBay Community Center staff of any discrepancies that might later affect your refund. The following things are required for you to receive your refund: 1. Remove all decorations,personal property and rented equipment from premises, 1 Place all tables and chairs on the racks provided in the storage room. 3. Sweep and mop all floors,including restrooms and kitchen(if used). Place sweepings in dumpster behind the building. 4. Remove all debris from kitchen and restrooms,including liners from trash containers and place in dumpster. 5. Have everyone in your group including caterers and other hired staff completely out of the building by the designated time. 6. Return all equipment in the same condition as when received. 7. In short,leave the room looking as it did when you arrived. FAILURE TO FOLLOW ANY OF THESE RULES LISTED will result in a partial or no refund. If there is any physical damage to the building,grounds or its furnishings and equipment,your deposit will be retained until the cost of repair and/or replacement can be determined and deducted from your deposit. If the cost of repair and/or replacement exceeds the deposit,such additional sum shall be immediately due and payable. RESERVATIONS,CANCELLATIONS LLATIQNS&MNSfERS Reservations I. Reservations for MonTaraBay Community Center can be made at the center on Mondays only,between 9:00 am.and 5:00 p.m..Tuesday through Thursdays reservations can be made at the Contra Costa County Public Works building,located at 255 Glacier Rd.,Martinez. 1 Reservations can be made up to 12 months in advance,but not less than seven(7)days before the requested daft of use(event). 3 Fees paid 15 working days or more prior to the requested date of use,may be paid via cash,check money order or cashier's check. 4. Fees paid 14 working days or less prior to the requested date of use may only be paid via cash,money order,or cashier's check. 5. Reservations are not considered confirmed until the cleaning/damage deposit is paid in full. Once the deposit is made,the reservation is considered confirmed. & The renter requesting use of the facility must submit the"Application for Use'in person. 7. The renter requesting the"Application for Use" must be signed by a responsible adult,minimum of 21 years of age or older. 8. No reservations will be taken on a continuous year to year basis. 9. Future reservations by any individual or group will not be accepted until any and all outstanding bills from prior uses have been paid in full, 10. Contra Costa County CSA M-17 reserves the right to re-schedule or cancel any rental without liability. Refunds will be made accordingly to the applicant Cancellations 1. ALL CANCELLATIONS MUST BE DONE IN WRITING BY THE PERSON WHO MADE THE RESERVATION,TO RECEIVE A REFUND OF THE FEES PAID. 2. A cancellation fee of$25.00 is charged for all cancellations. 1 Refunds of the cleaning/damage deposit,rental fees and security fee are based on the following time frame: a. 100%of the deposit,rental fee and security fee will be returned if notification is given 60 days prior to the requested date of use. b. 5001a of the deposit,rental fee and security fee will be returned if notification is given from 59 days up to 31 days prior to the requested date of use. c. Renters who cancel their original requested date of use 30 days or less before the event who do not give any notice of cancellation,will forfeit the entire cleaning/damage deposit,all rental fees and security fees. Transfers I- One date transfer is allowed between 61 -90 days prior to the original requested date of use,free of charge. 2. The new requested date of use will be held for 7 working days and will not be extended. 3. A written request to change the date must be receive within this 7-day period,or the request to transfer will not be considered. No exceptions 4. Transfers are based on the following time frame. a. One transfer date can be made up to 61 days before the original requested date of use,free of charge. b. A date transfer requested 60 days or less prior to the original requested date of use,will be charged a Transfer Fee of$50, Payment must be made in cashier check,money order or cash. c. A date transfer requested 30 days or lea. ,,-Jor to the original requested date of use,will be cha....<J a Transfer Fee of$75. Payment must be made in cashier check,money order or cash. No exceptions. RESIDENCY An individual or group may be considered a resident and entitled to resident rates if the primary place of residence is located within County Service Area M-17(Bayview Park,Tara Hills,Montalvin Manor&Hilltop Commons). All others will be charged according to the non-resident fee schedule. USE OF FACILITY L The consumption of alcoholic beverages Is not allowed anywhere outside of the building. 2. No rice,confetti or similar materials shall be permitted whether,inside or outside the facility. A violation of this rule will result in a twenty-five ($25)surcharge. 3. Masking tape and scotch tape are the only adhesives allowed to be used in decorating. 4. Adhesive,nails screws,tacks,staples and other similar materials are not permitted. Materials must be fire retardant and exits must not be covered or obstructed. All decorations must be removed from the site before the group leaves the building to be entitled to refund of the cleaning/damage deposit. 5. No equipment may be removed from the facility without prior approval. b. MonTaraBay Community Center staff will operate the heating system. 7. Equipment moved must be returned to the original positions and locations. 8. After the facility has been used,it must be left in a clean and orderly condition,in accordance with the MonTaraBay Community Center Cleaning Guidelines. You will be given a copy of the Cleaning Guidelines when you reserve the facility. The center must be left clean in accordance with the Cleaning Guidelines to receive the cleaning/damage deposit refund. Your signature indicates that you have read and agree to comply with the MonTaraBay Community Center Cleaning Guidelines. Initial Date 9. Renters may opt to not clean the facility after their use. Renter then forfeits the entire cleaning/damage deposit. Notification must be given at the time the Application for Use is received by staff. 10. Renters not giving prior notification of their intent not to clean-up after their event,and not leaving the Center in a clean and orderly fashion will automatically forfeit the entire cleaning/damage deposit. 11. A dumpster is located outside,at the rear of the building by the patio. 12. CSA M-17 will not provide supplies of any kind to groups or individuals using the facility. The renter must bring their own supplies and remove them when their event is complete. 13. Additional charges may be assessed against the renter resulting from the use of the facility beyond the time specified,damage to the facility or additional services in the nature of janitorial or maintenance work which may be required due to the use of the facility. The determination of the assessment of the additional charges shall be at the sole discretion of Contra Costa County. 14. The individual or organization granted use of any portion of the facility would be held responsible for any loss or damage to the property caused by such use. Such individual or organization must pay for the cost of repairing or replacing the damaged or lost property. 15. The kitchen is not equipped with dishes or utensils-the renter must provide their own supplies. 16. The use of helium filled balloons is allowed. However,should a balloon lodge in the ailing during the course of your rental and later(after you've departed)the balloon deflates and causes the Center's alarm system to be tripped,a$25 false alarm charge will be deducted from the cleaning/damage deposit. YOUTH GROUPS 1. Groups composed of minors must be supervised by one(1)pwem adult for each ten(10)minor children at all times while they are using the facility. 2. The"Application for Use must be completed by the adult parent supervising the function. 3. The names and telephone numbers of the designated chaperones must be submitted to the MonTaraBay Community Center or the Public Works Office no later than forty-eight(48)hours prior to the requested date of use of the facility. 4. Failure to submit names and telephones numbers of chaperon's 48 hours prior to the use of the facility may result in cancellation of the rental and forfeiture of all fees. 5. Renters failing to have designated chaperones present or the required ratio of adults(24-25 years of age or older)to children present during their rental period may result in immediate termination of the rental and forfeiture of the entire cleaning/damage deposit. 6. Alcohol beverages are not allowed on the premises(served or sold)throughout the entirety of a rental intended for individuals under 21 years of age. 7. Rentals intended for individuals under 21 years of age and under will be held between the hours of 8:00a m.to 10:OOp.m. GENERAL,REGULATIONS 1. Applicants are to use only those facilities or equipment specifically designated on the"Application for Use". 2. The renter shall procure at their own cost and expense,all permits and licenses required for the intended use of activity. 3. The"Application for Use"cannot be transferred,assigned or sublet. 4. All renters,both private and public,intending to sell alcoholic beverages must provide proof of a valid liquor license issued by the State of California Alcoholic Beverage Control Department. The liquor license must be submitted to the Public Works Department a minimum of 48 hours prior to the requested date of use. Failure to provide the liquor license by the deadline may result in cancellation of the rental and forfeiture of all fees. 5. The MonTaraBay Community Center will provide you with a letter to take to the Alcoholic Beverage Control Department,as needed. 6. Any person or persons violating the established Rules&Regulations constituting a public nuisance may be required to leave the facility and he renter may forfelt their entire cleaning/damage deposit. 7. Contra Costa County personnel shall have the right to enter the facility,at all times during any and all occupancies. 8. The individual or organization granted use of the facility will be held responsible for any loss or damage caused by their guests or anyone employed by them while using the facility. 9. The individual or organization granted use of the facility would be held responsible for any loss or damage to the property caused by such use. 10. The CSA M-17 staff is not responsible for setting up and/or taking down the tables and chairs,this is the responsibility of the User and must be completed within the contracted time period. 11. All deliveries must be scheduled during the reservation time. 12. No one may drive any vehicle onto the patio. 13. The volume of sound audible outside the building should not interfere with the publics right to the quiet enjoyment of the surrounding area. 14. a.Music that is not amplified is considered to be quiet music and is the only type of music that can be played outside the building. b.Amplified music may be played indoors only. c.After 10:00 p.m.,the center's doors must be closed so that the volume of sound is not audible outside of the building. d.Violation of the sound rule could result in immediate termination of the event and forfeiture of all fees. Initial Date 15. Time changes(i.e.entry/exit times)or facility use changes shall be made in writing by the renter a minimum of 24 hours prior to the date of use, or the renter will be charged for additional entry and or exit fees. 16. Misrepresentation of information provided on the rental application including but not limited to: 1)misrepresenting the type of activity; 2) misrepresenting residency of the applicant or sponsoring organization;3)exceeding the capacity of the facility;4)misrepresenting if alcohol will be served or sold;and 5)misrepresenting the number and/or age group of participants/guest. Violation of this rule may result in immediate termination of the event and forfeiture of the cleaning/damage deposit. 17. Security guards are required to be on the premises throughout the entirety of all rentals where alcoholic beverages are either served or sold TERMINATION BY CONTRA COSTA COUNTY The County of Contra Costa reserves the absolute right at any time prior to or during your use of the facilities,to cancel your reservation and to terminate this agreement in the event of emergency,casualty,physical damage to the building or other occurrence which,in the sole discretion of Contra Costa County Public Works Department render the facilities unsuitable or unsafe for use by you,or which requires use of the facilities for emergency purposes. Such occurrences include,without limitation,any of the following: 1. Fire,flood,earthquake,weather damage,other casualty or act of God causing physical damage to the facilities. 2. The making of improvements,alterations or repairs required by law or otherwise necessary to put or maintain the building and facilities in a safe and fully functional condition,including unexpected delays in the completion of such repairs,improvements,or alterations. 3. Fire,flood,earthquake,weather damage,other casualty or act of God creating an emergency situation on property other than the County premises for coordination of emergency relief efforts or for housing storage. 4. Power failure,restrictive governmental laws or regulations,riots,insurrections,wars or other causes beyond the County's reasonable control which render the facilities unfit or unsafe for your intended use.
