HomeMy WebLinkAboutRESOLUTIONS - 01011999 - 1999-127 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on March 16, 1999 by the following vote: AYES: Supervisors Gioia, Uilkema, Gerber, DeSaulnier and Canciamilla NOES: None ASSENT: None ABSTAIN: None RESOLUTION NO. 99/ 127 SUBJECT: Application for Federal Surface Transportation Program and Congestion Mitigation and Air Quality Improvement Program Projects. (25%-Corridor Management Program) Project No.: 0676-6P1049. This resolution authorizes the Contra Costa County Public Works Director to file applications for Federal Surface Transportation Program and Congestion Mitigation and Air Quality Improvement Program funding. The resolution commits the necessary local match for the projects and also states the assurance of the Public Works Department to complete the projects. Whereas, Contra Costa County Public Works Department has the authority for the exercise of certain powers to build and maintain public roads within the unincorporated sections of Contra Costa County; and Whereas, the Transportation Equity Act for the 21"Century(TEA 21) (Public Law 105-178, June 9, 1998) and the TEA 21 Restoration Act (Public Law 105-206, July 22, 1998) continue the Surface Transportation Program (23 U.S.C. s 133) and the Congestion Mitigation and Air Quality Improvement Program (CMAQ) (23 U.S.C. s 149); and Whereas, pursuant to TEA 21, and the regulations promulgated thereunder, eligible project sponsors wishing to receive Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program grants for a project shall submit an application first with the appropriate metropolitan transportation planning organization (MPO), for review and inclusion in the MPO's Transportation Improvement Program (TIP); and Whereas, the Metropolitan Transportation Commission (MTC) is the MPO for the San Francisco Bay region; and Whereas, Contra Costa County is an eligible project sponsor for the Surface Transportation Program and Congestion Mitigation and Air Quality Improvement Program funds; and Application for Federal Surface Transportation Program and Gongestion Mitigation and Air Quality Improvement Program Projects (25%-Corridor Management Program). February 23, 1999 Page 2 Whereas, Contra Costa County wishes to submit grant applications to MTC for funds from the Surface Transportation Program or the Congestion Mitigation and Air Quality Improvement Program in fiscal year 1998/99 for the following project: Ironhorse Trail overcrossing at Treat Boulevard near the Pleasant Hill BART Station. Whereas, MTC requires, as part of the application, a resolution stating the following: 1) the commitment of necessary local matching funds of at least 11.5%; and 2) that the sponsor understands that the Surface Transportation Program and Congestion Mitigation and Air Quality Improvement Program funding is fixed at the programmed amount, and therefore any cost increase cannot be expected to be funded with the Surface Transportation Program or Congestion Mitigation and Air Quality Improvement Program funds; and 3) The assurance of the sponsor to complete the project as described in the application, and if approved, as programmed in MTC's TIP. 4) The sponsor understands that the funds must be obligated by September 30, 2001, or the project may be removed from the program. Now, therefore, be it resolved, by the Board of Supervisors of Contra Costa County that the Contra Costa County Public Works Director is authorized to execute and file an application for funding of the following project under the Surface Transportation Program and the Congestion Mitigation and Air Quality Improvement Program of TEA 21: Surface Transportation P„ roject Title Pr2gram Funding Local Fundina Ironhorse Trail Overcrossing $500,000 $253,000 Be it further resolved that the Contra Costa County Board of Supervisors by adopting this resolution does hereby state that: 1) Contra Costa County will provide the above listed amounts in local matching funds for each project; and 2) Contra Costa County understands that the Surface Transportation Program and Congestion Mitigation and Air Quality Improvement Program funding for the project is fixed, and that any cost increases must be funded by Contra Costa County from local matching funds, and that Contra Costa County does RESOLUTION NO. 12J 17 Application for Federal Surface Transportation Program and UJngestion Mitigation and Air Quality Improvement Program Projects (25%-Corridor Management Program). February 23, 1999 Page 3 not expect any cost increases to be funded with Surface Transportation Program or the Congestion Mitigation and Air Quality Improvement Program funds; and 3) The listed project will be built as described in this resolution and, if approved, as programmed in the MTC Transportation Improvement Program (TIP). 4) The program funds are expected to be obligated by September 30, 2001. Be It further resolved, that a copy of this resolution will be transmitted to MTC in conjunction with the filing of this application, and Be it further resolved, that MTC is requested to support the application for the project described in the resolution and to program the projects, if approved, in MTC's TIP.
