RELEASE AND INDEMNIFICATION
Mr. and Mrs. R. Gretler, declare the following:
a. We are the owners of Lot 9 of Subdivision 4492 located at 9020 Double Tree Lane, Livermore,
California, as described in the Deed to us, recorded February 11, 1998, Series 98028 of Official Records at page
126 (the"Property").
b. We have obtained LUP 2026-98. Permitting us to construct a second residence with boat and
recreational vehicle storage.
C. In consideration of, and as a condition to,the granting of the permit referred to in subparagraph(b)
above,we, and each of us, agree to construct said dwelling unit in accordance with the building permit.
d. In further consideration of the granting of said LUP 2026-98,we, and each of us,hereby release the
County of Contra Costa, and the County Public Works Department and the County Flood Control District their
respective officers, agents and employees from any claim,cost, or liability arising out of or in connection with any
damage to the site improvements resulting from flooding and/or creek bank erosion.
e. In further consideration of the granting of said LUP 2026-98, we, and each of us, hereby agree to
defend,indemnify, and hold said County, and the County Public Works Department and the County Flood Control
District respective officers, agents, and employees harmless from any claims, costs, demands, expenses or liability,
including without limitation all consequential damages,arising out of or in connection with any damage to the site
improvements resulting from flooding and/or creek bank erosion.
f. This Agreement is an instrument affecting the title or possession of the real property described
above, and shall be binding on and inure to the benefit of all our heirs, successors, and assigns.
