HomeMy WebLinkAboutRESOLUTIONS - 01011998 - 1998-116 e.6 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY,CALIFORNIA Adopted this Resolution on March1791998,by the following vote: AYES: Supervisors Uilkema, Gerber, DeSaulnier, Canciamilla, Rogers NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO.: SUBJECT: Completion of Improvements, Road Improvement Agreement for widening along Neroly Road, DP 3407-96 (APN 051-220-039, 053), Oakley area. . The Public Works Director having notified this Board that the improvements for DP 3407.96 have been completed as provided in the Road Improvement Agreement with Carl Karcher Enterprises, Inc., heretofore approved by this Board; NOW THEREFORE BE IT RESOLVED that the improvements have been COMPLETED as of March 17, 1998, thereby establishing the six-month terminal period for the filing of liens in case of action under said Road Improvement Agreement: DAT` .OF AGREEMENT SURETY October 28, 1997 ALL CASH BOND BE IT FURTHER RESOLVED that the $5,000 cash security for labor and materials (Auditor's Deposit Permit No. 301243, dated September 9, 1997) deposited by Carl Karcher Enterprises,Inc.,be RETAINED for the six-month lien guarantee period until September 17, 1998, at which time the Public Works Director is AUTHORIZED to refund the cash security less the amount of any claims on file. BE IT FURTHER RESOLVED that the beginning of the warranty period is hereby established, and the$10,000 cash deposit/cash bond(Auditor's Deposit Permit No. 301243, dated September 9, 1997) made by Carl Karcher Enterprises, Inc., be RETAINED pursuant to the requirements of Section 94-4.406 of the Ordinance Code until released by this Board. WHEREAS the Flood Control District is constructing Flood Control Zone 313's San Ramon Creek Improvement Project-Chaney Road to Livorna Road this coming spring and summer; WHEREAS Flood Control Zone 313 requires the repayment of prior deposits to the Flood Control Revolving Fund to pay for said project in the amount of$1,300,000; WHEREAS the following entities have amounts of funds that are temporarily not needed and are available for deposit into the Flood Control District Revolving Fund to partially replace Flood control Zone 3B deposits to Flood Control Zone 7: Drainage Area 13 (7552) $100,000 Drainage Area 16 (7583) 70,000 Drainage Area 33A (7535) 228,000 Drainage Area 55 (7579) 100,000 Drainage Area 67 (7539) 70,000 Drainage Area 910 (7560) 30,000 Drainage Area 1010 (7580) 150,000 Flood Control District (7505) 1�5 ,000 $901,000 WHEREAS the following entities have amounts of funds that are temporarily not needed and are available for deposit into the Flood Control District Revolving Fund to partially replace Flood Control Zone 313 deposits to Drainage Area 73: Drainage Area 10 (7554) $ 75,000 Drainage Area 15A (7559) 25,000 Drainage Area 101A (7581) 45,000 County Service Area D2 (7602) 30,000 Flood Control District (7505) 19,000 $214,000 Resolution # 98/ 116 Approve Deposits by Several Drainage Areas to Flood Control District Revolving Fund to Repay Deposits by Flood Control Zone 3B, Countywide March 17, 1998 Page 2 WHEREAS said loans shall be repaid to the depositing entities within five years from the date of disbursement dependent upon monies available to said entities through drainage fees and other revenue. Repayment shall include interest on the unpaid balance at 5.5% per annum, which is the current rate received on similar types of investments by Contra Costa County as determined by the County treasurer. NOW THEREFORE BE IT RESOLVED, as the governing Board of Contra Costa County Flood Control and Water Conservation District, that said deposits and payments are approved.
