GRANT DEED OF DEVELOPMENT RIGHTS
For value received,I,Gerald W. Scatena,an unmarried man,owner,hereby grant to the County
of Contra Costa,a government subdivision of the State of California,grantee,and its governmental
successors, the future "development rights,' as defined herein below over a portion of that real
property situated in the County of Contra Costa, State of California, and more particularly described
in Exhibit A.
"Development rights" are defined to mean and refer to the right to disapprove of any proposed
construction, development or improvement, particularly if such construction, development or
improvement requires a building permit. The "development rights" are and shall be a form of
covenant which shall run with the said property and shall bind the current owner and any future
owners of all or any portion of said property.
Grantee will quitclaim development rights to owner when the following have occurred:
1. Improvements required under conditions of approval 15, 16,20,27, 28,29, 30, 32 and 35,
for Subdivision MS 16-96, and as shown on the "Drainage Plan" for this subdivision by
Isakson&Associates,Inc.,dated September 30, 1997,and October 1, 1997,and on file with
the County Public Works Department, are constructed and accepted as complete by the
County Board of Supervisors for at least six months, unless construction of those
improvements are assured by bonding under a subdivision agreement.
2. All of the land described in Exhibit A is annexed into Lighting District L-100,per condition
of approval 25 for Subdivision MS 960016.
3. Impact of this subdivision to San Ramon Creek is mitigated by channel excavation or
payment of an in lieu of excavation fee,per condition of approval 32 for Subdivision MS
960016.
