I am the owner of 3131 Walnut Boulevard located in Contra Costa County, California, as described in the Deed to us, as recorded January 27, 1986, in Book 355 of Official Records at page 12723 (the"Property"). b. We have obtained an encroachment permit to install a property fence within the road right of way of Shady Glen and Walnut Boulevard. C. In consideration of, and as a condition to, the granting of the permit referred to in subparagraph (b) above, I agree to construct, said fencing in accordance with the encroachment permit. d. In further consideration of the granting of said encroachment permit, I hereby release the County of Contra Costa, and its respective officers, agents and employees from any claim, cost, or liability arising out of or in connection with any damage resulting from the encroachment of the fence into County road right of way. e. In further consideration of the granting of said encroachment permit, I hereby agree to defend, indemnify, and hold said County, and its respective officers, agents, and employees harmless from any claims, costs, demands, expenses or liability, including without limitation all consequential damages,arising out of or in connection with any damage resulting from the encroachment of the fence into County road right of way. f. This Agreement is an instrument affecting the title or possession of the real property described and shall be binding on and inure to the benefit of all my heirs, successors, and asigns.
