HomeMy WebLinkAboutRESOLUTIONS - 12161997 - 97-695 Com, C.129 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on December 16 , 1997 by the following vote: AYES: Supervisors Rogers, Uilkema, Gerber, Canciamilla and DeSaulnier NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 97/695 r SUBJECT: ORDERING APPROVAL OF THE ALAMO SPRINGS BOUNDARY REORGANIZATION (LAFC 97-28) Acting as Conm ducting Authority under the Cortese-Knox Act Local Government Reorganization Act of 1985 (Government Code sections 56000 et seq.) ("Cortese-Knox Act"), the Board of Supervisors of Contra Costa County ("Board") finds, resolves and orders that: 1. This action is being taken pursuant to the "Cortese-Knox Act". 2. In August 1989, the Town of Danville ("Town") and Contra Costa County ("County") entered into a Memorandum of Agreement to undertake a joint jurisdiction General Plan and project review for the Alamo Springs Project including a 148-acre site formerly known as the Del Chase Property. After certification of an EIR for the project now known as the Alamo Springs residential subdivision("Project") by the Board at its meetings of December 8 and 15, 1992, the Board approved the Project(including Final Development Plan#3003-90). The unincorporated area of the Project was simultaneously rezoned to Planned Unit District. On December 17, 1996, The County approved a Revised Preliminary Development Plan and Final Development Plan for the Project (County File #DP953043) and Revised Vesting Tentative Map for the Project (County File#SD7452). 3. On November 19, 1997 the Local Agency Formation Commission of Contra Costa County ("LAFCO") approved Resolution No. 97-28 forming County Service Area M-30 ("CSA M-30"), establishing a sphere of influence for CSA M-30, annexing to (+/- 3.89 acres) and detaching from (+/- 7.46 acres)the Town and amending the Town's sphere of influence and designating the Board as Conducting Authority. These actions together constitute a"reorganization" under Government Code § 56073. LAFCO assigned these actions together the short-term designation"Alamo Springs Boundary Reorganization (LAFC 97-28)" ("Boundary Reorganization"). 4. The boundaries of CSA M-30 and its sphere of influence and the areas of annexation/detachment from the Town and the Town's amended sphere of influence are described in Exhibit A hereto. 5. The formation of CSA M-30 and the establishment of a sphere of influence for CSA M-30 are subject to the conditions that: extension or construction of any previously authorized charge, fee, assessment or tax by the County in the affected area; and there are no property tax revenues.for CSA M-30 that are subject to the property tax exchange provisions of Government Code Section 56842. 6. The formation of CSA M-30 and the establishment of a sphere of influence for CSA M-30 will implement the principles for appropriate development of the Alamo Springs residential subdivision, especially as described in Conditions of Approval 65, 94, 95 and 96 of the County's approval of the Preliminary and Final Development Plans, as modified by the County Zoning Administrator on May 19, 1997. The formation of CSA M-30 and the establishment of a sphere of influence for CSA M-30 will also enable the County, without extra cost to the County General Fund and the taxpayers outside of the Project to provide and finance extended public services to residents and property owners in the Project. 7. The annexation to (+/- 3.89 acres) and detachment from (+/- 7.46 acres) the Town and amending the Town's sphere of influence will ensure that all of the lots in the Project fall within either the Town or the County. 8. The regular County assessment rolls will be utilized. 9. The affected territory within the County will be taxed for existing general bond indebtedness of the County. The affected territory within the Town will be taxed for existing general bond indebtedness of the City. 10. The formation of CSA M-30 is exempt from the provisions of the California Environmental Quality Act (CEQA) for the reasons set forth in the LAFCO Executive Officer's Report on LAFCO Agenda Item 8c for the November 19, 1997 LAFCO meeting, and as set forth in LAFCO Resolution No. 9728. 2 11. The Local Agency Formation Commission has authorized this Board to approve the Boundary Reorganization without notice and hearing and without an election. 12.
