SUBJECT: Vacation of a Portion of Brookside Drive

The Board of Supervisors of Contra Costa County RESOLVES THAT:
This summary vacation of an excess right of way of a street or highway no longer
required for street or highway purposes, is made pursuant to Division 9, Part 3, Chapter
4 of the Streets and Highways Code, commencing with Section 8330, et seq. A description
of the portion to be vacated is described in Exhibit "A" and shown as Exhibit "B" attached
hereto and is located in the North Richmond area.
This vacation request is based on the fact that the street or highway has been
superseded by relocation (S. & H. Code Section 8330).
This vacation request is part of a larger project for which an EIR was prepared and
approved by the Board. The project has been determined to conform to the County's
General Plan.

This Board declares that the hereinabove described proposed vacation area is
HEREBY ORDERED VACATED subject to any reservation and exception described in
attached Exhibit "A". From and after the date this Resolution is recorded, the portion
vacated no longer constitutes a public highway.
The Real Property Division is ORDERED to record a certified copy of this
Resolution in the office of the County Recorder.

EXHIBIT "A"
Real property in an unincorporated area of the County of Contra Costa, State of California, being a
portion of the County Road known as Brookside Drive, formerly Road Number 17, described as
follows:
Beginning at the southeast corner of Lot B as shown on the Map of the Sampson Tams Ranch filed
July 1, 1907, in Book 1 of Maps at Page 7;thence from said Point of Beginning along the westerly
right of way line of Brookside Drive, north 0'3 8'18" east 82.19 feet; thence, leaving the westerly
right of way he of Brookside Drive north 58*59'16" east 46.99 feet to a point on the easterly right
of way he of Brookside Drive;thence along the easterly right of way line of Brookside Drive, south
0°38'18" west 157.24 feet to the northeast corner of Lot 56, as shown on the Map of the Niemeyer
Tract filed March 10, 1913, in Book 9 of Maps at Page 212, records of said County; thence along
the southerly right of way line of Brookside Drive north 88°47'37" west 295.15 feet; thence north
1°12'23" east 10.00 feet, thence north 88047'37" west 47.85 feet, thence leaving said right of way
northeasterly along a nontangent curve concave to the northwest, having a radius of 626.00 feet, a
radial to said curve bears south 6°1558" east, through a centra( angle of 14°27'44", an arc distance
of 158.00 feet to a point on the northerly right of way line of Brookside Drive, thence nontangent
to said curve being the northerly right of way line south 88°47'37" east 150.07 feet, to the Point of
Beginning.
Containing an area of 16876 square feet (0.387 acres) of land, more or less.
Bearings and distances are based on the California Coordinate System Zone III (CCS27). Multiply
given distances by 1.0000638 to obtain ground distances.
RESERVING THEREFROM: Pursuant to the provisions of section 8340 of the Streets and
Highways Code, the easement and right at any time, or from time to time, to construct, enlarge,
maintain, operate, replace, remove and renew those existing and in place utilities, as of the date of
recording this instrument, in upon, over and across any highway or part thereof proposed to be
vacated, including access to protect the property from all hazards in, upon, and over the area herein
before described to be vacated.
This real property description has been prepared by me or under my direction, in conformance with
the Professional Land Surveyors dict.
