HomeMy WebLinkAboutRESOLUTIONS - 12051995 - 95-594 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA In the Matter of Board of Supervisors ) Appointees ' Liability and Injury Coverage ) Resolution No. 95/ 594 In order to encourage participation of interested citizens in the activities of boards, commissions or committees appointed by the Board of Supervisors, IT IS BY THE BOARD RESOLVED: The following liability and injury coverage shall be provided under the County' s self-insurance program to members of boards, commissions or committees appointed by the Board of Supervisors who execute the "Agreement to County Liability and Injury Coverage. " Public Liability: The County, through its self-insurance program, shall defend and indemnify appointees upon request against liability arising out of acts or omissions occurring within the scope of the appointees ' responsibilities unless the appointee acted or failed to act through actual malice, fraud, corruption, or gross negligence. Appointees who use a vehicle in the course of their duties must maintain automobile liability insurance which, as a minimum, complies with the California Financial Responsibility Law and must have a driver's license. The protection afforded by the County shall be in excess only of any other public liability or automobile liability maintained by or which provides coverage for the appointee and shall not cover any damages to the appointee's vehicle including any deductible amount. Injury. to Appointees : Appointees are not entitled to workers ' compensation benefits . In lieu thereof and in return for their services to the County and the appointees ' waiver of any claim against the County for illness, injury or other harm arising from acts or occurrences while providing services, the County shall provide in the case of illness, injury or death resulting from acts or omissions while providing such services, reimbursement of County authorized or approved necessary medical expenses for expenditures which are not covered by the appointee's health plan, other available insurance coverage or other third party, i .e. , federal, state or other payment. The County may elect to have the County's Health Services Department provide the appointee ' s necessary medical care.
