Code. §§ 25210,15, to Provide Extended Public Facilities) 56426, 56652, 56653, and Services for the Dougherty 56700 & 56800.) Valley RESOLUTION OF APPLICATION TO THE LOCAL AGENCY FORMATION COMMISSION OF CONTRA COSTA COUNTY FOR APPROVAL TO INITIATE PROCEEDINGS FOR FORMATION OF COUNTY SERVICE AREA NO. M-29 AND FOR ESTABLISHMENT OF SPHERE OF INFLUENCE FOR COUNTY SERVICE AREA NO. M-29 RECITALS: 1. After certification of the Dougherty Valley EIR(Resolution No. 92-864), the County in 1992 approved a General Plan Amendment(Resolution No. 92-866) and Specific Plan(Resolution No. 92-867)for the development of Dougherty Valley. 2. The County,together with Shapell and Windemere,the developers of Dougherty Valley, has entered into various agreements to settle litigation brought by certain parties against the County as respondent, and against Shapell and Windemere as real parties in interest, relating to County's approval of the General Plan Amendment and Specific Plan and its certification of the Dougherty Valley EIR(collectively,the"Settlement Agreements"). The Settlement Agreements establish, among other things, certain procedures and standards that will be applied to County's consideration and approval of the future approvals , including the formation of a County Service Area. 3. The formation of a County Service Area will implement the principles for appropriate development of Dougherty Valley especially described in Article III of the Settlement Agreement in Town of Danville, et al. v. County of Contra Costa, et al., dated May 11, 1994,to implement Section 3.2(b) of the Development Agreement between County and Shapell for Country Club at Gale Ranch and Conditions 9, 37 and 39 of County's Conditions of Approval for Subdivision 7796 and Development Plan 3010-92 as modified by the Board of Supervisors on December 13, 1994, Country Club at Gale Ranch. 4. The formation of a County Service Area will enable the County,without extra cost to the County General Fund and the taxpayers outside of the Dougherty Valley,to provide and finance extended public services to the Dougherty Valley residents and property owners.
