THE BOARD OF SUPERVISORSOF CONTRA COSTA COUNTY, CALIFORNIA
AS THE GOVERNING BODY OF THE CONTRA COSTA COUNTY
FLOOD'CONTROL AND WATER CONSERVATION DISTRICT
Adopted this Resolution on June 22, 1993, by the following vote:

SUBJECT: ESTABLISHMENT OF STORM WATER UTILITY AREA 2 (Clayton) AND
IMPOSITION OF ANNUAL ASSESSMENTS
The Board of Supervisors of Contra Costa County, as the Governing Body of the Contra
Costa County Flood Control and Mater Conservation;District, RESOLVES THAT:
On April 6, 1993,this Board adopted'a resolution proposing to form the aforesaid storm
water utility area and to impose annual assessments therein for the purpose of paying
for the casts of activities undertaken, or to be undertaken, in connection with the national
pollutant discharge elimination system (NPQES)`'program; and
Pursuant to Section 12.5 of the Contra Costa County Flood Control and Water
Conservation District Act, 'a written report describing the proposed assessments and the
lots, parcels or classes of property proposed to be subject to the assessments has been
filed with the Clerk of the Board; and
On June 10, June 15 and June 22, 1993, this Beard held public hearings to hear public
testimony and to consider all objections or protests to the written report and the
proposed formation of said storm water utility area and the `imposition of annual
assessments; and
It appears from the affidavits of,publication on file with this Board that all notices required
to be given for such hearings have been duly and regularly given'and all procedures to
be followed have been followed, all in accordance with Sections 11 and 12.8 of the
Contra Costa County Flood Control and °Water Conservation district Act and Section
54954.6 of the Government Code; and
This Board has received a copy of a resolution approved by a majority of the members
of the Clayton City Council requesting formation'of said storm water utility area and the
imposition of assessments;
NOW, THEREFORE, this Board hereby CERTIFIES that the categorical exemption
document submitted to it by the Community' Development Department has been
completed in compliance with the California Environmental Ouality Act; and
This Board FINDS that a majority protest does not exist, in that, prior to the conclusion
of the June 22 public hearing,'the written protests Bled by owners of property within
Storm Water 'Utility Area 2 do not represent more than 50 percent' of the territory
proposed to be included within said storm water utility area; and
Having considered all objections or protests to the written report,this Board OVERRULES
such objections or protests

This Board hereby FORMS and ESTABLISHES Storm Water Utility Area 2, consisting of
the real property located within the incorporated limits of the City of Clayton, as shown
in the records on file with the Local Agency Formation Commission, as amended from
time to time to reflect annexations and detachments; and
This Board IMPOSES annual assessments for fiscal year 1993-94 within Storm Water
Utility Area 2, as set forth in Ordinance No. 93-47; and
This Board hereby DIRECTS the Chief Engineer to file with the County Clerk a Notice of
Exemption for this project and to file with the County Assessor and the County
Auditor/Controller a list of the parcels subject to the assessments levied for fiscal year
1993-94; and
This Board hereby DIRECTS the Clerk of the Board to file with the County Assessor and
the County Auditor/Controller a certified copy of this resolution.
