Resolution of Termination of
Offer of Dedication'
(S. & H. Code'§ 8335)
SUBJECT: Termination of Offer of Dedication of a portion of Marsh Creek Road,
W. 0. 41 04, Clayton Area.
The Board of Supervisors of Contra Costa County RESOLVES THAT:
This Termination of an Offer of Dedication of a certain excess right of way not
required for road purposes, Is made pursuant to Government Code Section W77.2(c)
and to Division 9 Part 3, Chapter 4 of the Streets and Highways Code, commencing with
Section 8330.
This termination request is for ars Offer of Dedication of'a portion of Marsh Creek
Road located in the CAayton area. A description of the offered area to be terminated is
attached hereto as Exhibit "A" and incorporated herein by reference.
This termination request is for an excess right-of-way of a street not required for
street purposes (S.&N. Code Section 8334).
Considering all facts before it,this Board FINDS there is no reasonable probability
that the County will accept the offered'`roadway into the County road system that no ,
public money has been expended for maintenance of the offered roadway and that it is
in the best interests of the County and the public that the offered area be privately owned
and maintained:'
This activity is not subject to California Environmental Quality Act pursuant to
section 15061 (b)(3) of Chapter 3 of the GEQA Guidelines as it can be seen with certainty'
that there is no possibility that the activity may have a significant effect on the environ
Ment:
This Board hereby TERMINATES the hereinabove described offer of dedication
and ABANDONS the right of the County to accept said offer, The Board is not aware of
any existing in place utilities in the subject area.
The Real Property Division is ORDERED to record a certified copy of this
Resolution'in the office of the County Recorder.

Real property in the east half of the southeast quarter of Section 34, Township 1 Forth, Range 1
East, Mount Diablo Meridian, Contra Costa County, California, being a portion of the "AREA
DEDICATED TO CONTRA COSTACOUNTY FOR ROADWAY PURPOSES" shown on the map of
Subdivision'MS 27-78 fled April 10, 1980 in Book 85 of Parcel reaps at page 36, described as
fellows:
Commencing at the northeast corner of PARCEL S (85 PM 36); thence along:the north lime of
PAROL B,south 70054'10"west 66.85 feet,to the most eastern corner of said dedicated area, the
True Point of Beginning; thence from the True Point of Beginning, along the southeast line of said
dedicated area, south 563047'00" west 209.91 feet, to a curve, concave to the northwest, having a
radius of 346.00 feet; thence along the arc of said curve, southwesterly and westerly 108.08 feet,
through a central angle of 17053'52 , to a point of cusp with a non-tangent curve, concave to the
northwest, having a radius of 428,00 feet, to which a radial bears south '21010'42" east; thence
leaving the southeast fine of said dedicated area, along the arc of said curve having a radius of
428.00 feet, easterly and northeasterly 112.06 feet, through a central angle of 15000'03", thence
north 5304915" east 14,04 feet to the north line of said PARCEL B (85 PM 38); thence along said
north line, north 7(r54'1 0" east 62.91 feet, to the True Point of Beginning.
Containing an area of 2,653 square feet (0.061 acre) of land, more or less;
Bearings are based on the California Ordinate System Zone III (G<C.S.27).
RESERVING THEREFROM: Pursuant to the provisions of Section 8340 of the Streets and Highways
Cade, the easement and right at any time, or from time to time, to construct, enlarge, maintain,
operate, replace, remove,and renew those existing and In place utilities, as of the date of recording
this instrument, in upon, over and across any highway or part thereof,proposed to be abandoned,
