THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on january 21 , 1992, by the following vote. AYES: Supervisors Powers, Fanden, Schroder;, Torlakson and McPeak NOES: None ABSENT: Mone ABSTAIN: None RESOLUTIONNO. 92/ 42 SUBJECT: in the Matter of Requesting the ) State Coastal Conservancy take ) such Actions' Necessary to Acquire ) th�uisition of the Shell Marsh ) WHEREAS, the Shell Marsh, together with surrounding upland ,areas is a'valuable habitat for waterfowl and other wildlife species; and WHEREAS, the marsh area is in need of 'enhancement; and WHEREAS,the State Coastal Conservancy is charged with the acquisition, development and enhancement of marshes and provision of public access and development of waterfront areas NOW, THEREFORE, BE IT RESOLVED that the Board of Supervisors hereby requests that the State Coastal Conservancy take such actions as may be necessary to acquire or assist other organizations in the acquisition of the Shell`. Marsh and upland areas, and to restore or enhance the marsh and establish appropriate facilities on the upland area of the property,'provided such actions' are in consultation with the County, City of Martinez and other interested public and private parties and meet all local permit and planning requirements I hereby certify that the foregoing is a true'and correct copy of a resolution entered in the minutes of the Board of Supervisors on the date aforesaid. BACKGROT.TNDIREAS©NS FOR RECOMMENDATIONS On January 7, 1992, Supervisor Fanden brought to ;,the attention of the Board, 'efforts by the Coastal Conservancy to acquire or aid in the acquisition of Shell Marsh and associated upland areas for public trust purposes. The issue was referred to the Water Committee, which recommends adoption of the resolution, with minor amendment, as attached. ' The Coastal Conservancy is working with the Shell Oil Spill Trustee Committee and other organizations to acquire the :Shell. Marsh area and associated upland. The Coastal Conservancy has indicated that Board request for Conservancy action by resolution is 'necessary in order to move forward with the project, i.e. "match Trustee Committee funds or authorize planning money".
