THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this order on February 23 , 1988 , by the following vote:
AYES: Supervisors Powers , Fanden, McPeak, Torlakson, Schroder .
NOES: None.

SUBJECT: Establishing the Deep Class ) RESOLUTION NO. 88/26
of Deputy County Counsel )
Whereas the Board of Supervisors has enacted Resolution 83/1, as amended,
referred to as the Salary Regulations, and Section 20 of that Resolution provides
for deep classes; and
The County Counsel has requested that the deep class of Deputy County Counsel be
established;
It is By the Board Resolved that effective February 1, 1988, the deep class of
Deputy County Counsel is established, with the compensation provisions and terms
and conditions of employment contained herein; the existing positions in the
Classes of Deputy County Counsel II , III and IV are assigned thereto as provided
herein, and the said classes are abolished.
1. Salary Range:
Compensation for the deep class of Deputy County Counsel is set by the
board of Supervisors and reviewed periodically during consideration of
compensation for County management classifications.
The following basic and advanced salary ranges correspond with the
Deputy County Counsel job specifications in which duties
and responsibilities are defined. The steps within each level are as
follows: Basic Level (Steps 1-8) , Standard Level (Steps 9-16) and
Advanced Level (Steps 17-24) .

Increments between steps are two and one-half percent (2 1/2%) within the
salary progression. For positions given Advanced Level assignments, step 22
is the maximum salary for excellent performance and steps 23 and 24 are
reserved for Outstanding Merit Performance salary advancement as provided in
Section 8b herein. For positions given Standard Level assignments, step 16
is the maximum salary for satisfactory performance. For positions given
Basic Level assignments, step 8 is the maximum salary for satisfactory
performance.
2. Initial Appointments:
Initial appointment into the class of Deputy County Counsel shall be made at
any step of the salary range for the level to which the employee is
qualified and appointed, as directed by the County Counsel , provided
however, that a promotional appointment must result in at least a five
percent (5%) salary increase, if the salary schedule for the level to which
the position is assigned permits such an adjustment.
3. Reassignment to a Higher Level :
A Deputy County Counsel who meets the minimum qualifications for a higher
level assignment may be reassigned by the appointing authority to the higher
level , and if so reassigned shall be placed at the first salary step of the
higher level irrespective of whether or not this results in a salary
adjustment of less than five percent (5%) . Assignment to a higher level is
the sole prerogative of the appointing authority. As additional
organizational or operational needs arise, Deputy County Counsel positions
may be added to or deleted from higher levels.
4. Probation:
Every initial appointment to a level and every reassignment to a higher
level is subject to a 12 month probationary period and affirmative action by
the appointing authority to confirm the appointment or reassignment.
Continued incumbency in any Advanced Level assignment is contingent upon the
incumbent continuing to receive annual performance evaluations which are
better than satisfactory.
5. Re-Employment:
Deputy County Counsels who terminate their employment with the County in
good standing and who are subsequently re-employed as a Deputy County
Counsel within the period of their re-employment eligibility may be
appointed at the assignment level and salary level at which they were
employed at the time of their termination provided that a vacant position
exists at the former assignment level . Said appointment will be at the
first salary step of the assignment level , unless otherwise provided for by
the appointing authority in which case employees may be appointed up to the
salary step at which they were employed at the time of their termination.
If a vacant position does not exist at the assignment level the employee
attained at the time of termination said employee may be appointed to a
lower assignment level position provided that a vacant position exists at
that level .
6. Definition and Application of Terms:
a. Reassignment means the movement of a position and its incumbent, if
filled, from one assignment level to another within the deep class.
b. Promotion, Demotion and Transfer - For the purposes of promotion,
demotion and transfer to and from the deep class of Deputy County Counsel ,
"salary" refers to and shall be based on the salary range established for
each of the assignment levels within the deep class rather than on the
bottom and top salary steps of the whole deep class.
7. Anniversary Dates:
a. Current, Probationary and New Employees - The anniversary date of a
Deputy County Counsel having probationary status as of the effective date of
this Resolution and of all Deputy County Counsels appointed thereafter shall

be the first day of the calendar month after the calendar month when the
Deputy successfully completes six months full-time service. Anniversary
dates of all current non-probationary employees shall remain unchanged upon
allocation to the deep class.
b. Reassignment to Higher Level Position - The anniversary date of a Deputy
County Counsel who is reassigned to a higher assignment level is determined
as for a new employee in "a" above.
c. Reassignment to Lower Level Position - The anniversary date of a Deputy
County Counsel who is reassigned from a higher assignment level to a lower
assignment level shall remain unchanged.
8. Salary Adjustments:
a. Merit Increments - Based upon review of each Deputy County Counsel 's
performance, the appointing authority may authorize a merit increment in the
salary of that Deputy County Counsel effective upon the anniversary date
unless deferred. Such adjustment shall consist of an advancement of the
employee's salary by one or two steps on the salary schedule established for
the Deputy's assignment level . In the case of less than satisfactory
performance, and as to the Advanced Level , less than excellent performance,
the employee's merit increment shall be deferred until such time as the
performance of the employee is satisfactory or excellent. No merit
increment shall be made unless an affirmative recommendation to do so is
made by the appointing authority, and no provision of this section shall be
construed to make the advancement of salaries mandatory. The appointing
authority may recommend unconditional denial of the merit increment; or make
the denial subject to review at some date preceding the next anniversary
date. Persons on military leave shall receive merit increments that may
accrue to them during the period of military leave.
b. Outstanding Performance Adjustment:
If the appointing authority deems that a Deputy County Counsel 's performance
has been outstanding , the employee's salary may be advanced in any
anniversary year not more than two steps on the appropriate salary schedule
established for that employee's assignment level . Such adjustment may be
awarded on other than the employee's anniversary date, for outstanding merit
performance only, provided that the adjustment may not be effective sooner
than 60 days after any merit increment granted effective on the employee's
anniversary date. Any additional step(s) awarded to reflect Outstanding
Performance shall remain in effect for twelve months only, may be sooner
terminated by the appointing authority, and may be renewed for consecutive
twelve month periods.
c. Salary adjustments other than Outstanding Merit steps and deferred Merit
Increments shall be effective on the employee's anniversary date.
9. Demotion:
A county employee who promotes from the deep class of Deputy County Counsel
and is subsequently reinstated to the class as the result of demotion or
failing probation will be reinstated to the assignment level and salary step
attained prior to promotion. Applicable rules on layoff and displacement
will be effectuated in the event a vacant position, at the assignment level
to which the employee is to be demoted, does not exist. Whenever the
demotion is the result of layoff, the salary of the demoted employee shall
be that step on the salary schedule of the assignment level from which the
employee was promoted which the employee would have achieved had the
employee remained continuously in that position, all within range increments
being granted on the anniversary dates in the demotional position.
10. Salary on Voluntary Demotion:
Notwithstanding Section 9, whenever any employee voluntarily demotes to
Deputy County Counsel at an assignment level which has a salary schedule
lower than the class from which the employee is demoting, the salary shall
remain the same if the steps in the new (demoted) salary schedule permit,

and if not, the new salary shall be at the highest permitted salary step
below the former salary.
11. Salary on Transfer:
Whenever a permanent employee transfers to a Deputy County Counsel position
at an assignment level , the salary schedule of which is allocated to the
same salary range as the class of the position which employee previously
occupied, the employee shall continue to be compensated at the same step of
the salary schedule.
12. Salary on Reassignment From a Higher Assignment Level to Lower Assignment
Level :
A Deputy County counsel who is reassigned from a higher assignment level
shall be placed at the step of lower assignment level salary schedule which
the employee would have achieved had the employee remained continuously in
the lower assignment level to which reassigned.
13. Reclassification of Position:
The salary of an employee whose position is reclassified to the Deputy
County Counsel deep class shall be established in accordance with the
applicable Sections of this Resolution. An employee in a position that is
reclassified from Deputy County Counsel to another class on the basic salary
schedule ,shall receive a salary based upon the Deputy County Counsel salary
for his/her level and the provisions of Resolution 83/1 or other applicable
deep class resolutions or ordinances.
14. Seniority:
The seniority of employees in the deep class of Deputy County Counsel for
layoff and displacement purposes shall be determined by Personnel Management
Regulations Rule 1205, provided that each Deputy County Counsel assignment
level shall be treated as a separate class, incumbents of lower assignment
level positions shall be considered as not meeting the requirements for
higher assignment levels, and incumbents of higher assignment level
positions shall be considered as meeting the requirements for lower
assignment levels. Current class seniority dates for employees being
allocated to this deep class shall remain unchanged.
15. Other Provisions:
a. The provisions of Resolution 83/1 and the Personnel Management
Regulations, as amended are applicable to the Deputy County Counsel deep
class subject to the provisions of this Resolution.
b. Deputy County Counsels must have the use of a privately owned vehicle
available during the course of their employment.
16. Y-Rate Defined:
As utilized in Exhibit A of this resolution, Y-Rate means the withholding of
any class-wide salary range adjustment unless otherwise authorized by the
footnote in Exhibit A.
17. Allocation of Existing Positions and Incumbents: (See Exhibit A)
