Resolution No. 88/701 u ect• Designation of the Count of S b� Design y Contra Costa as the Lead Agency and the Contf�a Costa County Redevelopment Agency as the Responsible Agency for the Preparation of an Environmental Impact Report for the Oakley Redevelopment Project Area. The Board of Supervisors of Contra Costa County RESOLVES THAT; Section 15050 of the California Environmental Quality Act (CEQA) Guidelines rres that when a project requiring an Environmental Impact Report (EIR) is to be carried out or approved by more than one public agency, one public agency shall be responsible for preparing the EIR for the project. This agency shall be called the Lead Agency. Contra Costa County is the public agency involved in the preparation a d adoption of the Oakley Area General Plan Amendment for which an EIR shall be prepared, and has the responsibility related to approving and carrying out the General Plan. . The Contra Costa County Redevelopment Agency, (the "Redevelopment Agency" ) upon direction from the Board of Supervisors has commenced prep iaration of an Oakley Redevelopment Plan for which an EIR is required. It is the intent of the Board of Supervisors and the Redevelopment Agency to have the Oakley Area General Plan EIR also serve as the Redevelopment Plan EIR and address those impacts created by the adoption of an Oakley Redevelopment Plan. Section 15051 of the CEQA Guidelines provide that where two or more public a encies have a substantial claim to be the Lead Agency, the pudic agencies may by agreement designate one of the agencies as th Lead Agency. The County an the Agency have mutually agreed that the County, as the legal entity responsible for approving and adopting the Plan in the first instance pursuant to the California Community Redevelopment Law, should serve as the "Lead Agency" and the Agency should serve as a "Responsible Agency" as defined in the CEQA Guideline The Board of 3u ervisors of the Count of P y Contra Costa hereby accepts and consents to its designation as the "Lead Agency" for the purposes of the preparation of an Environmental Impact Report for the Oakley Redevelopment Project.
