SUBJECT: Sale of Surplus Property
Pinole Creek

Pinole Area
The Board of Supervisors as the Governing Body of Contra Costa County Flood
Control and Water Conservation District RESOLVES THAT:
The District acquired an interest in the real property known as the Pinole Creek
Right of Way, a portion of which is described in Exhibit "A" attached hereto. Said
portion is DETERMINED to be surplus and no longer required for any District purposes
and its estimated value does not exceed $10,000.00.
This Board hereby APPROVES and AUTHORIZES the conveyance of said property to
the City of Pinole, pursuant to Government Code Section 25526.5 and the Board Chairman
is hereby AUTHORIZED to execute a Quitclaim Deed on behalf of the District in consider-
ation for the payment received in full in the amount of $500.00.
The Real Property Division is DIRECTED to cause the Quitclaim Deed to be delivered
to the Grantee.
The Board hereby FINDS that the project will not have a significant effect on
the environment, and DETERMINES that the project is exempt from the requirements
of the California Environmental Quality Act as a Class 12 Categorical Exemption under
County Guidelines and Section 15112 of the State CEQA Guidelines, and DIRECTS the
Public Works Director to file a Notice of Exemption with the County Clerk. The conveyance
has been found to be in conformance with the General Plan of the City of Pinole.

EXHIBIT 'A"
A portion of "Parcel 5b" conveyed to Contra Costa County Flood Control and Water
Conservation District by the City of Pinole as a non-exclusive right of way for use
as a roadway for vehicles of all kinds, construction equipment, men and materials,
for the purpose of ingress and egress from the channel of Pinole Creek, and recorded
September 23, 1965 in Book 4948, at page 483, Official Records of Contra Costa County,
California.
Beginning at a survey monument stamped "FCD 6651" marking the southwest corner of
"Parcel 5b"; thence along the boundary of "Parcel 5b" the following courses: North
400 50' 38" East 261 .00 feet, North 490 09' 22" West 10.00 feet, North 400 50' 38"
East 10.00 feet, and South 490 09' 22" East 25.00 feet; thence, leaving said boundary,
South 400 50' 38" West 271 .00 feet to a point on said boundary that bears South 490
09' 22" East 15.00 feet from the above described southwest corner of "Parcel 5b";
thence North 490 09' 22" West 15.00 feet to said southwest corner.
Containing 4165 square feet.
