The Board of Supervisors of Contra Costa County and the Board of
Supervisors of Contra Costa County as the Governing Body of Contra Costa County
Flood Control and Water Conservation District RESOLVES THAT:
A portion of the access easement acquired for the Miller Center West
Facility for the Handicapped as described in Exhibit "A", attached hereto, is no
longer necessary for County or other public purposes.
Portions of land owned by Chevron U.S.A. Inc. as described in Exhibit
"B" , attached hereto, are required for drainage improvements for Wildcat Creek
in the Richmond area.
This Board hereby APPROVES the exchange of all of the County' s right,
title and interest in and to said excess Miller Center access easement areas for
the required Wildcat Creek areas pursuant to Government Code Section 25365 and
Flood Control District Act Section 31 and the Chairman of this Board is hereby
AUTHORIZED to execute on behalf of the County a Quitclaim Deed to Chevron U.S.A.
Inc . for the property rights described in Exhibit "A", attached hereto. The
County Real Property Division is DIRECTED to cause said deed to be delivered to
the Grantees together with a copy of this Resolution.
The Easement Deeds from Chevron U.S.A. Inc. to Contra Costa County
Flood Control and Water Conservation District dated August 19, 1981 are
hereby ACCEPTED and the County Real Property Division is DIRECTED to have said
deeds recorded in the Office of the County Recorder.
The Board hereby FINDS that the project is exempt from Environmental
Impact Report requirements as a Class 5 Categorical Exemption under County
Guidelines and AUTHORIZES the Public Works Director to file a Notice of Exemption
with the County Clerk. The project has been determined to conform to the Richmond
General Plan.
PASSED by the Board on August 25, 1981 by at least a four-fifths vote:

All that portion of a non-exclusive right-of-way designated Parcel
Four in the Grant Deed from Standard Oil Company of California to
the State of California, dated May 25, 1966, and recorded August 11,
1966, in Book 5181, Page 506, Official Records of Contra Costa County,
that lies within the property described as Parcel A on Parcel Map
filed for record in Book 44 of Parcel Maps at Page 42, Contra Costa
County Records.

Parcel Four in the Grant Deed from Standard Oil Company of California
to the State of California, dated May 25, 1966, and recorded August 11,
1966, in Book 5181, Page 506, Official Records of Contra Costa County,
which lies within the property described as Parcel E on Parcel Map
MS 73 -5 recorded on April 2, 1974 in Volume 33 of Parcel Maps, Pages
1 through 6 inclusive and which lies easterly* of the following described
line.
Comencing at the most westerly corner of the parcel of land described
as Parcel 2 in the deed to City of Richmond, recorded April 17, 1963
in Book 4346 of Official Records at page 549; thence from said point
of commencement along the north line of said Parcel 2, North 72014'49"
East 251.51 feet„ North 82°12'52!' East 212.31 feet and North 63n20'20"
East 83.71 feet to the True Point of Beginning, thence from said True
Point of Beginning North 28°4659" West 87.36 feet to a point on the

Portions of Lots 17 and 16 of Section 3 and Lots 21 , 22, 23 and 24, of
Section 2 of Township 1 North, Range 5 West, Mount Diablo Meridian,
lying Within Contra Costa County, State of California, described as
follows:
A strip of land 600.00 feet in width, the centerline of which is
described as follows:
Beginning at a point on the easterly line of said Lot 21 of said
Section 2 (TIN, R5W) which bears North 290.00 feet along said easterly
line from the northwesterly line of the parcel of land described as
PARCEL ONE in the deed to John H. McCusker and Marian D. McCosker, his
wife, recorded March 10, 1965 in Book 4820 of Official Records at
page 57; thence, from said point of beginning, North 77000`00" West,
2950.00 feet to the westerly terminus of said 500.00 feet in width strip
of land.
PARCEL 2 (Existing Channels) :
Portions of Lots 27 and 28 of Section 2 and Lot 5 of Section 11 of
Township 1 North, Range 5 West, Mount Diablo Meridian, and portion of
San Pablo Canal as designated on Map No. 1 of Salt Marsh and Tide Lands
approved July 6, 1872, filed June 11 , 1917, Records of Contra Costa County,
State of California, described as follows :
A strip of land 30.00 feet in width, the centerline of which is the
centerline of Wildcat Creek, said centerline is bounded on the northeast
by the westerly boundary of the parcel of land described as PARCEL ONE
in the deed to John H. McCosker and Marian D. McCosker, his wife, recorded
March 10, 1965 in Book 4820 of Official Records at page 57, Records of
said County, and bounded on the southwest by the southerly line of the
parcel of land, described as PARCEL ONE in the deed to Chevron U.S.A. ,Inc. ,
(formerly Standard Oil Company of California) recorded December 16, 1958
in Book 3283 of Official Records at page 76, Records of said County.
