The Board of Supervisors of Contra Costa County RESOLVES THAT:
This vacation is made pursuant to Streets and Highways Code Section
8330. The subject right of way was offered for dedication in accordance with
the County' s circulation plan for the area north of John Muir School . Now
Subdivision 5988 is planned in the same area which is in the process of being
annexed by the City of Martinez. The City-approved plan for Subdivision 5988
has rendered surplus certain portions of the right of way offered for dedication
for the planned future extensions of Missouri Street and Kelly Avenue. The
City of Martinez has no objection to the proposed vacation of the surplus right
of way. For a description of the portion to be vacated, see Exhibits "A" and "B"
attached hereto and incorporated herein by this reference.
This Board hereby FINDS that the proposed vacation will not have a
significant effect on the environment, and that it has been determined to be
categorically exempt under State guidelines Section 15112 in compliance with
the California Environmental Quality Act. This vacation is not located in
an area of statewide interest or any potential area of critical concern.
This vacation was referred to the City of Martinez and pursuant to
Government Code §65402 and found to be in conformance with their General Plan.
The Board, having considered the General Plan, finds that in
accordance with its Resolution No. 81/522, this vacation is of a minor nature.
This Board declares that the hereinabove described proposed vacation
area is HEREBY ORDERED VACATED subject to any reservation and exception
described in attached Exhibit "A" and "B." From and after the date this
Resolution is recorded, the portion vacated no longer constitutes a highway.
This vacation is made under the Streets and Highways Code, Chapter 4, Sections
8330 et seq. The subject right of way has not been used for the purpose it was
offered for dedication nor was it accepted by the County.
The Public Works Director shall file with the County Clerk a Notice
of Exemption.
A certified copy of this Resolution, attested by the Clerk under seal ,
shall be recorded in the Office of the County Recorder.

described in the deed to Anthony E. and Kilda Roman, re-
corded May 11, 1977, in Bonk 8325 of Official Records,
Contra Costa County, at Page 117; thence North 11 11 '
00" East along the east line of said Roman Parcel, 69 . 72
feet; thence leaving said east line, South 880 49 ' 00"
East, 45. 00 feet, to a point on the west boundary of the

operation of gas pipelines, telegraphic and telephone lines , railroad

petroleum and its products, ammonia, water and for incidental purposes,
including access to protect such works from all hazards in, upon and
over the area hereinbefore described to be vacated.
